14 <br /> 1 The applicant has submitted conditions for consideration by the BOCC, as included in the <br /> 2 Ordinance in Attachment 9. One of the submitted conditions commits the applicant to request <br /> 3 water service from the Town of Hillsborough, should the rezoning request be approved by the <br /> 4 BOCC. Town of Hillsborough Administration has reviewed this condition and provided a memo of <br /> 5 support for that condition, which is available for review in Attachment 5. <br /> 6 <br /> 7 Public Notification: In accordance with Section 2.8.7 of the UDO, notices of the Public Hearing <br /> 8 were mailed via first class mail to property owners within 1,000 feet of the subject parcel. These <br /> 9 notices were mailed on October 22, 2025, 15 days before the meeting. Staff also posted the <br /> 10 subject parcel with a sign on October 22, 2025, 15 days before the meeting. See Attachment 3 <br /> 11 for the notification materials. <br /> 12 <br /> 13 Planning Board Recommendation: The Planning Board reviewed the Zoning Atlas Amendment at <br /> 14 its September 3, 2025, regular meeting. At this meeting the Board voted 4-4 on a motion to <br /> 15 recommend approval of the Statement of Consistency (Attachment 7) and the proposed Zoning <br /> 16 Atlas Amendment (Attachment 9), as presented. Due to the split vote, the motion was not <br /> 17 approved, and the Planning Board continued its consideration of the application to its October 1, <br /> 18 2025 meeting at which the Board voted 9-0 to recommend approval with conditions. An excerpt <br /> 19 of the Planning Board's September 3, 2025 approved meeting minutes and an excerpt of the <br /> 20 October 1, 2025 draft meeting minutes are included at Attachment 6. The Planning Board's <br /> 21 signed Statement of Consistency is also provided at Attachment 6. <br /> 22 <br /> 23 Planning Director's Recommendation <br /> 24 The Planning Director recommends that the Board of County Commissioners: <br /> 25 1) Consider the matter for action; <br /> 26 2) Acknowledge that legally sufficient public notice was given for the application and this <br /> 27 meeting, in accordance with State and Orange County laws; <br /> 28 3) Review the staff report(Attachment 2),featuring analyses of compliance with the UDO, <br /> 29 impact to the surrounding area, safety and efficiency of land use, and consistency with <br /> 30 the county's adopted plans; <br /> 31 4) Allow for the applicant's presentation of materials; <br /> 32 5) Conduct the public hearing, receive public comments, and consider the Planning <br /> 33 Board recommendation; <br /> 34 6) Close the public hearing; and <br /> 35 7) Vote to Approve the Statement of Consistency (Attachment 7) and Zoning Atlas <br /> 36 Amendment Ordinance (Attachment 9). <br /> 37 OR <br /> 38 Vote to Deny the Zoning Atlas Amendments, including a statement as to why the <br /> 39 application is not reasonable and/or not in the public interest, as detailed in the <br /> 40 Statement of Inconsistency (Attachment 8). <br /> 41 <br /> 42 Taylor Perschau, Current Planning and Zoning Manager, made the following presentation: <br /> 43 <br /> 44 <br />
