25 <br /> 1 • To ensure that the use of the property is for active recreation purposes, or if desired, more <br /> 2 specifically for a soccer field complex; <br /> 3 • Some degree of public and local government access to the future soccer fields; <br /> 4 • Provision of a trail corridor through the property to connect south and north to current and <br /> 5 future open space; <br /> 6 • As per a 2024 rezoning action, re-routing of the access easement on the property to the <br /> 7 adjacent Acer, LLC property and low-impact recreation area be addressed in any <br /> 8 approved site plan and plat; and <br /> 9 • If sold to a nonprofit, including a restriction that the property reverts to the County if it <br /> 10 ceases being used as a soccer field complex. <br /> 11 <br /> 12 Options for the Board to consider to facilitate this outcome given the procedural requirements for <br /> 13 a potential sale might include: <br /> 14 <br /> 15 A private negotiated sale of the property, which once completed would be announced and <br /> 16 scheduled for action at a future Board meeting. The property sale would be accompanied <br /> 17 by binding conditions placed on the property and benefits to both parties that would be <br /> 18 signed prior to or during the closing. <br /> 19 <br /> 20 Enter into a lease of the property of up to ten (10) years in length (the time limit allowed <br /> 21 by law)for the purposes defined. The lease must be structured in such a way that it is not <br /> 22 an attempt to circumvent the statutory prohibition on leases. The prohibition is that any <br /> 23 lease of ten (10) years or longer must be treated as a sale. <br /> 24 <br /> 25 The County could enter into a structured agreement with another party to contribute to the <br /> 26 costs of upgrading the property to support a soccer complex, and contract with that party <br /> 27 to manage the facility for a term with multiple renewal options. <br /> 28 <br /> 29 The County could sell the property without conditions under the negotiated sale upset bid <br /> 30 process, with no memorandum of understanding and no control or say on the future use <br /> 31 of the property. <br /> 32 <br /> 33 The County could retain ownership of the property, either for the present or permanently. <br /> 34 <br /> 35 At this point, the County has not received a formal offer for the property, so opening the door to <br /> 36 solicitation of the same would be the first step required. <br /> 37 <br /> 38 Staff requests the Board's direction as to 1) whether to entertain offers to purchase the property <br /> 39 or a portion thereof, 2) whether to retain the western natural resource lands in County ownership <br /> 40 for now, and 3) the manner of sale or lease process as outlined above. <br /> 41 <br /> 42 David Stancil, DEAPR Director, introduced the item.
