On October 6, 2015 the BOCC established Findings of Fact for the case and approved a <br /> SPECIAL USE PERMIT for the establishment of a Schools : Elementary , Middle , and Secondary on <br /> the property ., The project subject to thi s SPECIAL USE PERMIT is shown on the site plan dated April <br /> 4b 145 2014 , by Summit Design and Engineering Services (See attached Exhibit B) and conditi ons are <br /> outlined below. The terms herein are binding on the present owners and any lessees, as well as their <br /> do <br /> successors in title and in interest', until this permit either expires pursuant to U D""' 0 Sections <br /> and 2 . 7 . 14 , or i* s otherwise changed by government action . <br /> The Schools : Elementary , Middle, and Secondary use shall operate ion accordance with the site plan as <br /> described above , and all the commitments contained in the application shall be observed . Copies of the <br /> final site plan and supporting documentation are on file in the Orange County Planning and Inspections <br /> Department. <br /> In order to promote the public health, safety , and general welfare as required in Section 5 . 3 . 2 (A)(2) (a) ',, <br /> ensure adjacent property values are mai ntai ned or enhanced as required in Section 5 . 3 . 2 (A)(2)(b) ; and <br /> ensure the proposed use is in II h armony with te general area as require in Section . 3 . 2 (A) (2)(c) , the <br /> following conditions for this Special Use Permit apply : <br /> 1 . That the school be limited to serving 350 students as proposed by the applicant within the <br /> Special Use Permit application. <br /> 2 . The granting of this Special Use Permit does not confer onto the applicant authorization to <br /> commence construction/land disturbance activities . No land disturbance activity shall <br /> commence until all appli IS cable approvals, as detalled within the Unified Development <br /> Ordinance , have been obtained . <br /> 3 . Th &1 <br /> e submittal of a Solid Waste Permit application shall be required for every individual <br /> development p roject associ ated with this proj ect. <br /> 4 . xisting vegetation shall be preserved and remain 111 in an undisturbed state in general <br /> CIOnformance with Shcets) C4 , C5 , and C6 of the approved site plan, as appropriately adjusted <br /> pursuant to Site Plan review for individual construction phases . <br /> 5 . That the Fire Marshal and representatives of the New Hope Volunteer Fire Department shall <br /> review and approve the floor plan of proposed new bul' Idings prior to the issuance of any <br /> 0 Building and/or Zoning Compliance Permits) approving construct ion verify ing that the <br /> structures comply with all applicable NC Fire Protection Code standards . <br /> 6 .
