<br /> CONCLUSIONS OF THE ORANGE COUNTY BOARD OF ADJUSTMENT
<br /> PERTAINING TO A REQUEST SUBMITTED BY
<br /> WALDORF EDUCATIONAL ASSOCIATION OF NORTH CAROLINA
<br /> PROPOSING A MAJOR MODIFICATION TO EXISTING SPECIAL USE PERMIT
<br /> ON A PARCEL OF PROPERTY LOCATED AT 6211 NEW JERICHO ROAD
<br /> SUP25-0009
<br /> (PINS 9871646437, 9871658140, 9871743098, and 9871721935)
<br /> When applying the adopted Findings of Fact to the relevant Standards found in the UDO, the
<br /> Orange County Board of Adjustments makes the following Conclusions:
<br /> 1. All necessary submittal requirements were met, including:
<br /> a. Submittal of proper forms (UDO 2.2, Finding of Fact 1); and,
<br /> b. Fees paid (UDO 2.2.4(D), Finding of Fact 1); and,
<br /> c. The use was fully described (UDO 2.5.3(F) and 2.7.3(B)(1), Finding of Fact 2-10);
<br /> and,
<br /> d. Owner Information was provided (UDO 2.7.3(B)(2), Finding of Fact 1 and 2); and,
<br /> e. The facilities were described (UDO 2.7.3(B)(1), Finding of Fact 2-10); and,
<br /> f. Access, parking, and use were identified (UDO 2.5.3(F), 2.5.3(L), 5.8.4, Finding of
<br /> Fact 2 and 18); and,
<br /> g. Plans were identified (UDO 2.5.3(K) and 2.7.3(B)(1), Finding of Fact 2 and 18);
<br /> and,
<br /> h. Site plans were submitted, (UDO 2.5, Finding of Fact 2 and 18); and,
<br /> i. A list of parcels within 1,000' was provided (UDO 2.7.3(B)(5), Finding of Fact 2)
<br /> and;
<br /> j. Environmental Assessment was submitted (UDO 2.7.3(B)(7), Finding of Fact 2);
<br /> and,
<br /> k. Method of Debris Removal was described (UDO 2.7.3(B)(8), Finding of Fact 2);
<br /> and,
<br /> I. Development Schedule was provided (UDO 2.7.3(B)(9), Finding of Fact 2), and
<br /> m. A Landscape and Tree Preservation Plan was provided (UDO Section
<br /> 5.8.4(A)(1)(b), Finding of Fact 2, 6, and 19); and
<br /> n. A Traffic Impact Study was addressed (UDO Section 5.8.4(A)(1)(e), Finding of Fact
<br /> 2 and 9); and
<br /> o. A Biological Inventory was provided (UDO Section 5.8.4(A)(1)(f), Finding of Fact 2
<br /> and 10); and
<br /> p. A Resources Management Plan was provided in accordance with the Resources
<br /> Management Plan definition in Article 10 of this Ordinance (Section 5.8.4(A)(1)(g),
<br /> Findings of Fact 2, 11, and 19)
<br /> 2. Proper notice was provided as required by statute and ordinance, including:
<br /> a. Notice was mailed for the Neighborhood Information Meeting (UDO 2.7.5(B),
<br /> Finding of Fact 13); and,
<br /> b. Signs were posted for the Neighborhood Information Meeting (UDO 2.7.5(D),
<br /> Finding of Fact 15); and,
<br /> c. Notice was mailed for the Evidentiary Hearing (LIDO 2.7.6(A)(1), Finding of Fact
<br /> 14); and,
<br /> d. Signs were posted for the Evidentiary Hearing (LIDO 2.7.6(A)(2), Finding of Fact
<br /> 15).
