Wilson <br /> 21 and applicant Dr. Nora Dennis. The application proposes a "Care Facility" use on a portion <br /> 22 of the+1-9.67-acre parcel(PIN 9850-09-3606) located 1009 Hi Mar Lane, Chapel Hill, NC,within <br /> 23 the Bingham Township of Orange County. <br /> 24 <br /> 25 Taylor Perschau: So, I'm going to move forward with the staff presentation, testimony, and on the findings of <br /> 26 fact. After you hear from me, you'll hear from the applicant and then we'll be open for <br /> 27 questions and deliberation. So, to orient us to the property at hand. The property is located <br /> 28 in the Bingham Township, so the southwestern portion of Orange County. On the map that <br /> 29 you're seeing on the screen,the subject property is denoted by the red star. It is split by three <br /> 30 different watersheds, as well as three different zoning districts. The watersheds here are the <br /> 31 Cane Creek protected, University Lake protected, and Haw River unprotected. As discussed, <br /> 32 the current zoning is agricultural residential, rural buffer, as well as rural residential. The map <br /> 33 you're seeing, the different colorings represent those different zonings, so the dark green is <br /> 34 where that rural buffer zoning comes across the property. The lighter green represents <br /> 35 agricultural residential, and then the yellow represents the rural residential. So, the unified <br /> 36 development ordinance does define a care facility as a permitted use within all three of these <br /> 37 zoning districts. It's permitted with the issuance of a special-use permit which is why you are <br /> 38 a reviewing a special-use permit application for this use. The request is proposing that the <br /> 39 entirety of the 9.67-acre tract be, that the special-use permit be applied to the entirety of that <br /> 40 subject parcel in accordance with the submitted site plan available, and the agenda packet. <br /> 41 The surrounding zoning matches the three zones I just noted, so agricultural residential, rural <br /> 42 buffer, and rural residential. The entirety of the property itself as well as all surrounding <br /> 43 properties are zoned for residential uses. When reviewing a special-use permit application, <br /> 44 you are tasked not only to view the use in accordance with the zoning, but also in accordance <br /> 45 with the future land use map designations. In this instance, the land use designations from <br /> 46 the future land use plan match the language that we have in the zoning uses, but there is a <br /> 47 little bit of different language that the future land use plan gives to these categories. So, for <br /> 48 rural residential, it's defined by the land use plan as land in rural areas of the county which is <br /> 49 appropriate for low intensity, and low-density residential development, and which would not <br /> 50 be dependent on urban services during the plan period.
