The Applicant presented competent, material and substantial <br /> evidence intending to establish that the General Standards <br /> described in the UDO at Section 5.3.2 (A) and the specific standards <br /> at Section 5 .3 .2 (B) are met or will be met. <br /> 12 . The Applicant presented competent, material and substantial <br /> evidence intending to establish that each of the following General <br /> Standards described in the UDO Section 5.3.2 (A) are or will be met <br /> as follows : <br /> a. The proposed special use as it exists and as is modified <br /> maintains and promotes the public health, safety and general <br /> welfare if located where proposed and developed and operated <br /> according to the plan as submitted. <br /> b. The special use as proposed will maintain or enhance the value <br /> of contiguous property. <br /> C. The special use as proposed and the location and character of <br /> the use, if developed in accordance with the plan submitted, <br /> will be in harmony with the area in which it is to be located, <br /> and the use is in compliance with the plan for the physical <br /> development of the County as embodied in the UDO and the <br /> Comprehensive Plan. <br /> 13 . No competent, material or substantial evidence to the contrary was <br /> presented on the Record. <br /> CONCLUSIONS OF LAW <br /> Based on the competent, material and substantial evidence presented <br /> in the record, the proposed modification of special use proposed <br /> satisfies all standards set forth in the UDO applicable to this <br /> Application.
