<br /> 1 <br /> <br /> <br />CHILD SUPPORT ENFORCEMENT LEGAL SERVICES <br />MEMORANDUM OF AGREEMENT <br /> <br /> <br /> This Memorandum of Agreement (“Agreement”) is entered into this 13th day of <br />November, 2025, by and between the Orange County Child Support Services <br />Department (“CSS”) and the office of the Orange County Attorney (“Legal”) (referred to <br />collectively as the “Parties”). <br /> <br />WHEREAS, CSS is mandated to collect child support payments and establish, <br />modify, and enforce child support payment judicial orders; and <br /> <br />WHEREAS, Legal is a department of Orange County Government organized by <br />and reporting to the Orange County Board of Commissioners; and <br /> <br /> WHEREAS, the Parties desire to enter into this Agreement in order to establish <br />the mutually agreed upon conditions upon which Legal will provide certain services to <br />CSS in connection with child support enforcemen t. <br /> <br /> <br /> NOW, THEREFORE, the Parties to this Agreement hereby agree as follows: <br /> <br />1. Legal will provide consultation, legal advice, and representation as requested by <br />CSS on legal matters arising from the duties of CSS under Article 9 of Chapter <br />110 of the North Carolina General Statutes, Title IV-D of the Social Security Act, <br />and the federal regulations lawfully promulgated pursuant thereto. <br /> <br />2. Legal will appear in court and represent CSS as needed. If an attorney other than <br />the assigned IV-D attorney will be representing CSS, Legal will notify CSS in <br />writing as soon as reasonably possible. If Legal has a conflict of interest under <br />the Rules of Professional Conduct governing attorneys Legal shall notify CSS <br />within ten (10) days of discovering the existence of the conflict. <br /> <br />3. Legal will comply with all applicable laws, rules, and regulations, and more <br />specifically with the requirements of Article 9 of Chapter 110 of the North <br />Carolina General Statutes, Title IV-D of the Social Security Act, and the <br />regulations promulgated pursuant thereto relating to the performance of the legal <br />services including, but not limited to, maintaining such records as are required by <br />CSS, to assist with reports for federal or state audit, if required, and to assist with <br />progress reports as may be needed. <br /> <br />4. Legal will maintain accurate records of time spent on work provided under this <br />Agreement and shall invoice CSS for each month’s work by the 5th day of the <br />following month. <br /> <br />5. For the services under this Agreement, CSS agrees to pay Legal Ninety-One <br />Dollars and Ninety-Nine Cents (91.99) per hour for each hour spent providing <br />legal services to CSS.
