ENV-CPL 00003 00 (02/12) Page 21 of 22 <br />Includes copyrighted material of Insurance Services Offices, Inc. with its permission. <br />a.Physical injury to or destruction of tangible property, including all resulting loss of use and <br />diminished value of that property; <br />b.Loss of use of tangible property that is not physically injured or destroyed arising out of physical <br />injury to or destruction of or diminished value of other tangible property; or <br />c.Natural resource damage. <br />Property damage does not include clean-up costs or environmental damage. <br />Property damage shall include monetary awards or settlements of compensatory damages and <br />where allowable by law, punitive, exemplary, or multiple damages, and civil fines, penalties, or <br />assessments for property damage. <br />For the purpose of this insurance, electronic data is not tangible property. As used in this definition, <br />electronic data means information, facts or programs stored as or on, created or used on, or <br />transmitted to or from computer software, including systems and applications software, hard or floppy <br />disks, CD-ROMS, tapes, drives, cells, data processing devices or any other media which are used <br />with electronically controlled equipment. <br />27.Responsible manager means you, your manager or supervisor responsible for environmental <br />affairs, control or compliance or any other employee authorized by you to give or receive notice of an <br />occurrence or claim. <br />28.Restoration costs means reasonable and necessary expenses incurred by you with our written <br />consent to repair or replace damaged real or personal pr operty when such damage occurs because <br />of clean-up costs to which this insurance applies. Restoration costs shall not exceed the <br />replacement cost of such real or personal property. If repair or replacement results in kind or quality <br />exceeding that of the real or personal property before it was damaged, whether at your option or not, <br />we will not pay for the amount of the betterment. <br />29.Suit means a civil proceeding in which damages because of bodily injury, property damage, <br />environmental damage or emergency response expense to which this policy applies are alleged. <br />A suit includes: <br />a.An arbitration proceeding in which such damages are claimed and to which the insured must <br />submit or does submit with our consent; or <br />b.Any other alternative dispute resolution proceeding in which such damages are claimed and to <br />which the insured submits with our consent. <br />30.Temporary worker means a person who is furnished to you to substitute for a permanent worker on <br />leave or to meet seasonal or short-term workload conditions. <br />31. Transportation means the movement of goods, product, merchandise, supplies or waste in a <br />conveyance by the insured or a third-party carrier properly licensed to transport such goods, <br />products, merchandise, supplies or waste from the time of movement from the point of origin until <br />delivery to the final destination. Transportation includes the movement of goods, products, <br />merchandise, supplies or waste into, onto or from a conveyance. <br />32.Underground storage tank means any tank that has at least ten percent (10%) of its volume below <br />ground at inception of the policy period, or installed thereafter including associated underground <br />piping connected to the tank. <br />Docusign Envelope ID: 03EC0D15-D674-4D12-9ED3-8A2C214EE218
