ENV-CPL 00003 00 (02/12) Page 20 of 22 <br />Includes copyrighted material of Insurance Services Offices, Inc. with its permission. <br />provincial government, any foreign government, any Native American tribe, or, if such resources are <br />subject to a trust restriction on alienation, any member of a Native American tribe. <br />22.Non-owned site means any location which: <br />a.Was not at any time owned or occupied by, or rented or loaned to any insured; and <br />b.Is a location where waste generated from work or operations performed by you or on your behalf <br />is sent for treatment, storage, processing, recycling or disposal. <br />Non-owned site does not include: <br />a.Any location which is not licensed by the appropria te state or federal authority to perform storage, <br />disposal, processing or treatment of waste from your operations or your work in compliance with <br />environmental law. <br />b.any location or any part thereof that has been subject to a consent order or corrective action <br />under environmental law or is listed or proposed to be listed on the National Priorities List (NPL) <br />prior to waste from your operations or your work being legally consigned for delivery or delivered <br />for storage, disposal, processing or treatment. <br />23.Occurrence means an accident, including continuous or repeated exposure to substantially the same <br />general harmful conditions. <br />24.Policy Period means the period of time as shown in Item 2. of the Declarations, however, if the <br />policy is cancelled in accordance with SECTION V – CONDITIONS, 3. Cancellation, of this policy, the <br />policy period ends on the effective date of such cancellation. <br />25.Pollution incident means the discharge, emission, seepage, migration, dispersal, misdelivery, <br />release or escape of: <br />a.any solid, liquid, gaseous or thermal irritant or contaminant, including smoke, vapors, soot, fumes, <br />acids, alkalis, chemicals, hazardous substances, petroleum hydrocarbons; <br />b.low level radioactive waste; <br />c.microbial matter; <br />d.legionella pneumophila; <br />e.medical, infectious and pathological waste; <br />f.waste materials; and <br />g.electromagnetic fields; <br />into or upon land, or any structure on land, the atmosphere or any watercourse or body of water <br />including groundwater, provided such conditions are not naturally present in the environment in the <br />concentration or amounts discovered. <br />26.Property damage means: <br />Docusign Envelope ID: 03EC0D15-D674-4D12-9ED3-8A2C214EE218
