Agreement (“Personal Data” shall have the meaning ascribed to it in Regulation (EU) <br />2016/679). Whenever AirDNA processes Customer Personal Data, the relevant Privacy <br />Policy (https://www.airdna.co/privacy-policy), and/or Cookie Policy applies <br />(https://www.airdna.co/cookie_policy). The Parties acknowledge and agree that the DPA <br />will apply only to the extent Data Protection Laws and Regulations apply to the <br />Agreement, as those terms are defined in the DPA. <br />10. Data Delivery and Deletion <br />10.1. Data Delivery. Where applicable, and subject to the specific provisions contained <br />in Customer’s Order Form, AirDNA will deliver the data reports comprised in the Data <br />Services electronically, on tangible media, or by other means, in AirDNA's sole <br />discretion, according to the delivery schedule terms agreed to in the applicable Order <br />Form. <br />10.2. Data Deletion. Where applicable, and subject to the specific provisions contained <br />in Customer’s Order Form, AirDNA will deliver the data reports comprised in the Data <br />Services within forty-eight (48) hours of Customer’s payment of the applicable Fees. If <br />AirDNA is storing data via S3 Bucket, Google Drive, or any other storage type, such data <br />will only be retained for forty-five (45) days as of the date it was initially available to <br />Customer. The Customer is solely responsible for collecting the data within that time <br />frame. After such 45-day period, AirDNA shall have no obligation to maintain or provide <br />any such data and will, unless legally prohibited, delete all data reports in its systems or <br />otherwise in its possession or under its control.  <br />11. API Access and Usage <br />11.1 In the event that your subscription includes access to our API, AirDNA will provide <br />Customer with an API access token within three (3) business days of the Effective Date. <br />11.2. In the event that your subscription includes access to our API, Customer <br />acknowledges and agrees that it will not:  <br />11.2.1. access AirDNA APIs in violation of any law or regulation;  <br />11.2.2. access AirDNA APIs in any manner that (i) compromises, breaks or circumvents <br />any of our technical processes or security measures associated with the Data Services, <br />(ii) poses a security vulnerability to customers or users of the Data Services, or (iii) tests <br />the vulnerability of our systems or networks;  <br />10/23/25, 1:37 PM Enterprise Terms of Service <br />https://www.airdna.co/legal/enterprise-terms-of-service 11/15 <br />Docusign Envelope ID: 071B8E12-6074-40C4-9776-8B9CE9408BBE
