ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: April 1, 2003 <br />Action Agenda <br />Item No. ;~ ~ -q <br />SUBJECT: Personnel Ordinance Revision -Drug and Alcohol Testing <br />DEPARTMENT: Personnel <br />PUBLIC HEARING: (Y/N) No <br />ATTACHMENT(S): <br />Draft Personnel Ordinance Revision <br />INFORMATION CONTACT: <br />Elaine Holmes, Personnel Director, <br />Extension 2550 <br />TELEPHONE NUMBERS: <br />Hillsborough 732-8181 <br />Chapel Hill 968-4501 <br />Durham 688-7331 <br />Mebane 336-227-2031 <br />PURPOSE: To receive a report on possible revisions to the Orange County Personnel <br />Ordinance to update the policy covering employee drug and alcohol testing and to implement <br />the Board's direction as to handling positive drug and alcohol tests. <br />BACKGROUND:: The attached draft revised policy arises from direction received from the <br />Board of County Commissioners and from changes in Federal regulations covering certain <br />employees performing transportation-related functions. <br />Board of Commissioners' Direction <br />At the Board of Commissioners' October 21, 2002 work session, the Board discussed the <br />County's drug and alcohol testing policy, focusing on policy covering positive drug or alcohol <br />tests. The County's present policy provides that in the case of a: <br />• Positive drug. test, the employee is dismissed. <br />• Positive alcohol test, the employee is dismissed if the department head determines that <br />consumption occurred while on duty. If the department head determines consumption <br />occurred while off duty, the employee is subject to disciplinary action that may include <br />dismissal. <br />As a result of the Board's discussion, the Board asked Personnel to bring back a Personnel <br />Ordinance revision to the drug and alcohol testing policy for the Board's consideration that: <br />• Would provide the same handling for a positive alcohol test as a positive drug test and <br />
