11 <br /> Control Officer. Permit Application forms must be signed by the landowner or his <br /> authorized agent. The agent signing must have a signed letter of authorization <br /> from the owner. <br /> No permit is required for the following activities: <br /> 1. For the purpose of fighting fires. <br /> 2. For the stock piling of raw or processed sand, stone, or gravel in material <br /> processing plants and storage yards, provided that sediment control measures <br /> have been utilized to protect against off-site damage. <br /> 3. For disturbances that do not exceed 20,000 square feet in surface area. In <br /> determining the area, lands under one or diverse ownership being developed as <br /> a unit will be aggregated. <br /> B. Erosion Control Plan Approvals <br /> An Erosion Control Plan must be submitted to the Erosion Control Officer when <br /> the proposed land disturbance is greater than 20,000 square feet, or for any <br /> land-disturbing activity within the University Lake Cane Creek or Upper Eno <br /> Watersheds. <br /> C. Land Disturbing Permits <br /> Before starting a land-disturbing activity greater than 20,000 square feet, or any <br /> land-disturbing activity if within the University Lake, Cane Creek, or Upper Eno <br /> Watersheds, the owner or his agent shall obtain a Land Disturbing Permit from the <br /> Erosion Control Officer. Erosion Control Plans must be approved before a Land <br /> Disturbing Permit will be issued. Land Disturbing Permits may be obtained when the <br /> Plan is approved or prior to the start of the land disturbance <br /> Section 18 Erosion and Sedimentation Control Plans <br /> A. Plan Requirement <br /> An Erosion Control Plan shall be prepared for all land-disturbing activities subject <br /> to this Ordinance whenever the proposed activity is to be undertaken on a tract <br /> comprising more than 20,000 square feet, if more than 20,000 square feet are to be <br /> uncovered - or as otherwise noted in this Ordinance. Three (3) copies of the Plan shall <br /> be filed with the Erosion Control Officer, one copy of which will be simultaneously <br /> forwarded to the Orange Soil and Water Conservation District, at least 30 days prior to <br /> the commencement of the proposed activity. <br />
