Please revise Exhibit B to accurately reflect the three zoning districts in which the <br />subject property is located (AR/RB/R1). <br />2. Narrative currently details that “Jubilee has permission from Orange County Planning <br />and Zoning” to operate its current office-based services. Please revise to accurately <br />reflect that no permits or approvals have been granted for the existing use as the use is <br />currently operating as a bona fide farm use, which is exempt from County zoning per <br />NCGS 160D-903. <br />3. Please clarify the distinction between “office based” and “facility based” services noted in <br />the narrative. Staff understands the special use being requested is “Care Facility,” Use <br />#19 in UDO Section 5.2 Table of Permitted Uses. <br />4. Narrative and site plan note “proposed future building site.” Staff recommends preparing <br />a condition to be submitted as part of Exhibit E, Proposed Conditions that captures the <br />the proposed 0.5 acre portion being requested for that future building. <br />5. In the “Mitigating Potential Impact on Neighbors” portion of the narrative refers to a <br />“client’s home” when it seems “neighbor’s home” is intended. <br />6. Please advise how UDO Section 5.8.2(B)(1)(a) is being met. The language details: <br />“Where a State license is required to operate the facility, evidence that the minimum <br />requirements to qualify for said license have been, or will be, met shall be submitted.” <br />7. Please provide documentation to satisfy UDO Section 5.8.2(B)(1)(b). The language <br />details the submittal requirement as follows: “A floor plan of the proposed facility, <br />showing the use and dimensions of each room and the location of entrances and exits.” <br />8. Proposed Findings of Fact, Exhibit D reference that testimony will demonstrate <br />compliance with UDO Section 5.8.2, but staff does not find any submitted documentation <br />that reflects the same.
