c. Mr. McPhaul has been practicing as a licensed real estate appraiser in Orange <br />County and the surrounding area for more than thirty years. <br />d. Mr. McPhaul’s specialized technical knowledge will assist the BOA in understanding <br />the evidence and the impact, if any, that the proposed special use will have on the <br />value of contiguous properties. <br />10. The Applicant presented competent, material, and substantial evidence tending to establish <br />that each of the Specific Standards, described in UDO Sec. 5.3.2(B), are or will be met, as <br />follows: <br />a. The Applicant presented documentary evidence in the form of a Wastewater <br />Operation Permit and County Well Certificate evidencing the fact that the Specific <br />Standard 5.3.2(B)(1) is met and the proposed special use adequately addresses the <br />provision of sewage disposal facilities, solid waste disposal, and water. <br />b. The Applicant presented documentary evidence in the form of emails from the <br />Orange County Fire Marshal and Orange County Emergency Services evidencing <br />the fact that Specific Standard 5.3.2(B)(2) is met and the proposed special use <br />adequately addresses the provision of police, fire, and rescue squad protection. <br />c. The Applicant presented documentary evidence in the form of a Trip Generation <br />Letter from a licensed traffic engineer evidencing the fact that Specific Standard <br />5.3.2(B)(3) is met, and the proposed special use adequately addresses the provision <br />of vehicular access to the site and traffic conditions around the site. <br />d. The Applicant presented documentary evidence and testimony by Dr. Nora Dennis <br />evidencing the fact that all other Specific Standards applicable to Care Facility <br />special uses, including but not limited to those in UDO Sec. 5.8.2, have been or will <br />be met. <br />e. The Applicant presented evidence that the Subject Property has access to Dairyland <br />Road, which is a State-maintained road, via Hi Mar Lane and Dodsons Knoll Road. <br />The Applicant presented documentary evidence in the form of an executed and <br />recorded Amended Declaration of Restrictions and Provisions for Private Road <br />Maintenance agreement, recorded in Orange County Registry Book 6104 at Page <br />302, guaranteeing the Applicant’s right of access over Hi Mar Lane and Dodsons <br />Knoll Road and to Dairyland Road. <br />11. The Applicant presented competent, material, and substantial evidence tending to establish <br />that each of the General Standards, described in UNDO Sec. 5.3.1(A)(2), are or will be met, <br />as follows: <br />a. The Applicant presented documentary evidence in the form of testimony by Dr. Nora <br />Dennis evidencing that General Standard 5.3.2(A)(1)(a) is met and the proposed <br />special use will maintain or promote the public health, safety and general welfare, if <br />located where proposed and developed and operated according to the plan as <br />submitted because the proposed Care Facility use is specifically intended to promote <br />the public health, safety, and welfare. Dr. Dennis also testified that approval of the <br />Application and the proposed special use will not materially change the design or <br />operation of the Property because the Property is already developed and use for the <br />same purpose under the bona fide farm zoning exemption, and the Application has <br />been submitted solely to facilitate additional licensure for the facility. <br />49
