5. POTENTIAL BOA CONFLICT OF INTEREST STATEMENT <br /> <br />It is the duty of every Board member to avoid both conflicts of interest and appearances <br />of conflict. Board members having any conflicts of interest or appearances of conflict with <br />respect to matters before the Board should identify the conflict or appearance of conflict <br />and refrain from undue participation in the matter involved. <br /> <br />As a reminder, NC General Statute § 160D-109 establishes the following standard: A <br />member of any board exercising quasi-judicial functions pursuant to this Chapter shall not <br />participate in or vote on any quasi-judicial matter in a manner that would violate affected <br />person’s constitutional rights to an impartial decision maker. Impermissible violations of <br />due process include, but are not limited to, a member having a fixed opinion prior to <br />hearing the matter that is not susceptible to change, undisclosed ex parte <br />communications, a close familial, business, or other associational relationship with an <br />affected person, or a financial interest in the outcome of the matter. <br /> <br /> <br />6. CASES <br /> <br />To review and hold a quasi-judicial hearing for a Special Use Permit (Case <br />SUP25-0016). <br /> <br />A SUP request has been submitted by property owners Kenneth H. and <br />Joanne A.P. Wilson and applicant Dr. Nora Dennis. The application proposes <br />a “Care Facility” use on a portion of the +/- 9.67-acre parcel (PIN 9850-09- <br />3606) located 1009 Hi Mar Lane, Chapel Hill, NC, within the Bingham <br />Township of Orange County. <br /> <br /> <br />7.
