29
Perdita Holtz connected the concepts on this slide to other county regulations, including
UDO prohibitions on water/sewer in the rural buffer, the zoning district charts in Article three of
the UDO where access or no access to water and sewer systems are mentioned, and the land
use and zoning matrix in Appendix F of the Comprehensive Plan, which zoning are considered to
be consistent with land use classifications. She explained that all of this ties together to indicate
where water and sewer can and cannot be provided. She explained that this impacts development
because there cannot be dense development if there are no water and sewer systems.
Commissioner Portie-Ascott asked if there is a termination date for this agreement.
Perdita Holtz said this agreement is in effect until one party withdraws or all parties
reconvene to renegotiate the terms of the agreement. With that said, she explained that there
have been four or five amendments over the years, and while most of them were rather small,
there have been expansions and changes to the primary service area.
Chair Bedford said she recalls seeing a recommendation or suggestion that the parties re-
examine the agreement every 10 years.
Cy Stober said a 10-year review and readoption was proposed in the draft CLUP that the
Board saw in the spring.
Slide #13
Amending the Agreement
• Prescribed Process in Section II.D
• Any change requires approval of all parties to the
agreement
• The addition of other parties to the agreement requires
the consent of the current parties
ORANGE COUNTY
NORTH CAROLINA
Slide #14
Withdrawal from the Agreement
• Prescribed Process in Section ILE
• Party wishing to withdraw must hold a public hearing
on the proposed withdrawal
• Written notices to the other parties after public hearing
• Withdrawal effective one year after receipt of written
notice by other parties
• Withdrawal of one party does not invalidate the
Agreement with respect to the remaining parties
ORANGE COUNTY
NORTH CAROJJNA
