He said he did not understand
why the condition stated "subject to NCDOT approval" regarding the addition of turn lanes.
Beth Trahos said if NCDOT turns them down for whatever reason, the applicant would
have to go back through the amendment process. She said they added that language because
they cannot control it.
Josh Reinke said he believed that everyone agrees that it is unlikely that NCDOT will
turn it down. He said it is subject to NCDOT approval, and it is highly likely they will approve.
He said they can't promise it because they still need NCDOT approval.
Commissioner Carter said she thought that NCDOT must approve a turn lane on
Highway 54.
Commissioner Greene said NCDOT didn't require it, so now they must approve it.
Commissioner McKee said the wording was concerning. He said he was also
concerned about the last sentence in condition 10, which read "The subject property shall be
developed generally in accordance with the proposed site plan submitted as a part of this
application." He asked what "generally" meant.
