36
Chair Bedford said she wanted to remove some of the conditions as they seemed
burdensome to planning staff. She referred to slide #12:
Current Summary of Conditions 5-10
8. No less than 25 acres of Open Space areas shown on the Site Plan shall collectively include a
total of;
a.one(1)covered,open airstructure similarto those shown on the attached Exhibit C in the general
area identified asthe"Community Building Structure"on the Site Plan;
b.at least two(2f griIIingstations;
c.at least one(1)fire pit;
d.atI east four(4)trash cans;
e.at least four(4)pet waste stations;and
f.at least ten(10)bird nesting boxes in the general area identified as a"bird sanctuary"on the Site
Plan,all to be maintained by the HOA.
9. Individual septic systems meeting Orange County requirements and designed to serve homes
with four(4)bedrooms shall be provided on each residential lot.
10. Subject to NCDOTapproval,the property owner shall provide a right-hand turn lane
(deceleration)and a left-hand turn lane(center lane)into the property entrance on Highway 54
meeting INC DOT standards.The subject property shall be developed generally in accordance with
the proposed site plan submitted as a part of this application("Site Plan").
ORANGE COUNTY
NORTH CAROLINA
Chair Bedford said she wanted to remove items b-f from section 8 of the conditions.
Commissioner Greene said she supported the removal.
Commissioner Carter asked how the removal would impact the preservation of open
space.
Chair Bedford said she only wanted to remove items b-f in condition 8.
Cy Stober said the open space areas are designated and cannot be developed for
anything else.
Commissioner Portie-Ascott asked from a process standpoint, if conditions are removed,
does the applicant need time to go back and consider them.
Beth Trahos said the applicant is comfortable removing items b through f from section 8.
John Roberts said that staff will need the applicant to put their agreement in writing,
stating that they had reasonable time to consider the removal and they do not need additional
time, and that they are amenable to removing those five things.
Beth Trahos said she could confirm that the applicant was amenable to removing those
five things, and that she would put it in writing.
Commissioner McKee asked why the conditions were included and if they were a
distraction. He asked what the county would gain or lose.
Chair Bedford said that staff would have to enforce the conditions.
Commissioner McKee said he did not feel it was burdensome.
Cy Stober said a zoning regulation applies to this property in perpetuity until it is
amended by the board at a public hearing. He said if those items remain in as a condition, they
would be enforceable actions, including, for example, if different parties within the HOA invite
staff in as an arbitrator on say a bird house or a trash can. He said staff would be obligated to
enforce that zoning regulation through enforcement methods.
Commissioner McKee asked how the conditions were decided.
