Subject to NCDOTapproval,the property owner shall provide a right-hand turn lane <br /> (deceleration)and a left-hand turn lane(center lane)into the property entrance on Highway 54 <br /> meeting INC DOT standards.The subject property shall be developed generally in accordance with <br /> the proposed site plan submitted as a part of this application("Site Plan"). <br /> ORANGE COUNTY <br /> NORTH CAROLINA <br /> Chair Bedford said she wanted to remove items b-f from section 8 of the conditions. <br /> Commissioner Greene said she supported the removal. <br /> Commissioner Carter asked how the removal would impact the preservation of open <br /> space. <br /> Chair Bedford said she only wanted to remove items b-f in condition 8. <br /> Cy Stober said the open space areas are designated and cannot be developed for <br /> anything else. <br /> Commissioner Portie-Ascott asked from a process standpoint, if conditions are removed, <br /> does the applicant need time to go back and consider them. <br /> Beth Trahos said the applicant is comfortable removing items b through f from section 8. <br /> John Roberts said that staff will need the applicant to put their agreement in writing, <br /> stating that they had reasonable time to consider the removal and they do not need additional <br /> time, and that they are amenable to removing those five things. <br /> Beth Trahos said she could confirm that the applicant was amenable to removing those <br /> five things, and that she would put it in writing. <br /> Commissioner McKee asked why the conditions were included and if they were a <br /> distraction. He asked what the county would gain or lose. <br /> Chair Bedford said that staff would have to enforce the conditions. <br /> Commissioner McKee said he did not feel it was burdensome. <br /> Cy Stober said a zoning regulation applies to this property in perpetuity until it is <br /> amended by the board at a public hearing. He said if those items remain in as a condition, they <br /> would be enforceable actions, including, for example, if different parties within the HOA invite <br /> staff in as an arbitrator on say a bird house or a trash can. He said staff would be obligated to <br /> enforce that zoning regulation through enforcement methods. <br /> Commissioner McKee asked how the conditions were decided. <br />
