7 <br /> 1 STAFF COMMENT. The NIM was held on April 29, 2025, at 7:00 p.m. at Antioch <br /> 2 Baptist Church, 1707 White Cross Road, Chapel Hill. <br /> 3 • THIRD ACTION — The Planning Board reviews the application at a regular meeting <br /> 4 and makes a recommendation to the Board of County Commissioners (BOCC). <br /> 5 STAFF COMMENT. The Planning Board reviewed this application at its regular <br /> 6 meeting on August 6, 2025, and recommended approval by a 6-3 vote. <br /> 7 • FOURTH ACTION — The BOCC receives the Planning Board and staff <br /> 8 recommendations at an advertised public hearing and makes a decision on the <br /> 9 application. <br /> 10 STAFF COMMENT: The public hearing is scheduled for October 7, 2025. <br /> 11 <br /> 12 Proposed Site Plan and Conditions <br /> 13 Per Section 2.9.1 (F) (3) of the UDO, mutually agreed upon conditions can be imposed as part of <br /> 14 this process if they address: <br /> 15 a. The compatibility of the proposed development with surrounding property, <br /> 16 b. Proposed support facilities (i.e. roadways, and access points, screening and buffer areas, <br /> 17 the timing of development, etc.), and/or <br /> 18 c. All other matters the County may find reasonable and appropriate or the petitioner may <br /> 19 propose. <br /> 20 <br /> 21 Orange County Development Advisory Committee staff has recommended the imposition of <br /> 22 conditions, as included in the Ordinance in Attachment 9. <br /> 23 <br /> 24 A formal site plan is required as part of a conditional rezoning application and has been submitted <br /> 25 (Attachment 1). Forestar Group, Inc., on behalf of Carolyn Rigsbee, have initiated a Zoning Atlas <br /> 26 Amendment in order allow for future development of a 43-lot subdivision for single-family <br /> 27 dwellings. Additional background information related to this request, including information on <br /> 28 proposed dedicated open space, impervious surface, and amenities, is contained in the Staff <br /> 29 Report (Attachment 2). <br /> 30 <br /> 31 Public Notification: In accordance with Section 2.8.7 of the UDO, notices of the Public Hearing <br /> 32 were mailed via first class mail to property owners within 1,000 ft. of the subject parcel. These <br /> 33 notices were mailed on September 24, 2025, 13 days before the meeting. Staff also posted the <br /> 34 subject parcel with a sign on September 24, 2025, 13 days before the meeting. See Attachment <br /> 35 3 for the notification materials. <br /> 36 <br /> 37 Planning Board Recommendation: The Planning Board reviewed the Zoning Atlas Amendment at <br /> 38 its August 6, 2025, regular meeting.At this meeting the Board voted 6-3 to recommend approval <br /> 39 of the Statement of Consistency (Attachment 7) and the proposed Zoning Atlas Amendment <br /> 40 (Attachment 9), as presented, with the exception of correcting an error in Condition #3 to <br /> 41 accurately reflect the conditions as submitted by the applicant in Attachment 1. <br /> 42 <br /> 43 Planning Director's Recommendation: <br /> 44 The Planning Director recommends that the Board of County Commissioners: <br /> 45 1) Consider the matter for action; <br /> 46 2) Acknowledge that legally-sufficient public notice was given for the application and this <br /> 47 meeting, in accordance with State law and the Orange County UDO; <br />
