He said that on average, someone is murdered by domestic <br /> 22 violence every five and a half days, and that figure has increased in the last five years. He thanked <br /> 23 the Board for recognizing Domestic Violence Awareness Month and for their support. <br /> 24 <br /> 25 5. Public Hearings <br /> 26 a. Zoning Atlas Amendment— 3531 NC Highway 54 W, Chapel Hill, Bingham Township <br /> 27 The Board held a public hearing, receive the Planning Board and staff recommendations, received <br /> 28 public comment, closed the public hearing, and approved a Zoning Atlas Amendment to rezone <br /> 29 +/- 61.11 acres (PIN: 9749-42-2010) located at 3531 NC Highway 54 W, Chapel Hill, within the <br /> 30 Bingham Township of Orange County. <br /> 31 <br /> 32 BACKGROUND: A Conditional Zoning Atlas Amendment application (Attachment 1) was <br /> 33 received from Forestar Group, Inc., on behalf of Carolyn Rigsbee, proposing to rezone <br /> 34 approximately 61.11 acres of property at 3531 NC Highway 54 W, Chapel Hill, to allow for <br /> 35 development of a 43-lot conservation cluster subdivision for single-family dwellings. The Staff <br /> 36 Report in Attachment 2 contains additional information, maps, and analysis with regard to the <br /> 37 application's consistency with County adopted plans. Approval of a site-specific plan is part of the <br /> 38 conditional district rezoning process, and the site plan and any agreed-upon conditions are <br /> 39 binding to the development permitted for the zoning district. <br /> 40 Basic Review Process: A conditional district rezoning application requires submission of a site <br /> 41 plan and other documents, in accordance with Section 2.9.1(C) of the Orange County Unified <br /> 42 Development Ordinance (UDO). All application materials can be found on the Orange County <br /> 43 Permit Portal. Sections 2.8 and 2.9 of the Orange County UDO require the following review: <br /> 44 FIRST ACTION —Application is sent for courtesy review. <br /> 45 STAFF COMMENT: County staff submitted application materials to the State <br /> 46 Clearing House for review on February 18, 2025. Comments were received from <br /> 47 the Orange Grove Fire Department on July 18, 2025. All courtesy review <br /> 48 comments are available on the Orange County Permit Portal. <br /> 49 • SECOND ACTION —Applicant holds a Neighborhood Information Meeting (NIM). <br />
