36 <br /> Current Summary of Conditions 8-10 <br /> 8. No less than 25 acres of Open Space areas shown on the Site Plan shall collectively include a <br /> total of: <br /> a.one(1)covered,open air structure similarto those shown on the attached txhibit C in the general <br /> area identified as the-Community Building Structure'on the Site Plan; <br /> b.at least two(2)grilling stations: <br /> c.at least one(1)fire pit; <br /> d.at least four(4)trash cans; <br /> e.at least four(4)pet waste stations;and <br /> f.at least ten(10)bird nesting boxes in the general area identified as a"bird sanctuary'on the Site <br /> Plan,all to be maintained by the NDA. <br /> 9. Individual septic systems meeting Orange County requirements and designed to serve homes <br /> with four(4)bedrooms shall be provided on each residential lot. <br /> 10. Subject to NCOOT approval,the property owner shall provide a right-hand tum lane <br /> (deceleration)and a left-hand turn lane(center lane)into the property entrance on Highway 54 <br /> meeting NCOT standards.The subject property shall be developed generally in accordance with <br /> the proposed site plan submitted as a part of this application("Site Plan"). <br /> ORANGE COUNTY <br /> NOWFI I CAROLINA <br /> 1 <br /> 2 Chair Bedford said she wanted to remove items b-f from section 8 of the conditions. <br /> 3 Commissioner Greene said she supported the removal. <br /> 4 Commissioner Carter asked how the removal would impact the preservation of open <br /> 5 space. <br /> 6 Chair Bedford said she only wanted to remove items b-f in condition 8. <br /> 7 Cy Stober said the open space areas are designated and cannot be developed for <br /> 8 anything else. <br /> 9 Commissioner Portie-Ascott asked from a process standpoint, if conditions are removed, <br /> 10 does the applicant need time to go back and consider them. <br /> 11 Beth Trahos said the applicant is comfortable removing items b through f from section 8. <br /> 12 John Roberts said that staff will need the applicant to put their agreement in writing, stating <br /> 13 that they had reasonable time to consider the removal and they do not need additional time, and <br /> 14 that they are amenable to removing those five things. <br /> 15 Beth Trahos said she could confirm that the applicant was amenable to removing those <br /> 16 five things, and that she would put it in writing. <br /> 17 Commissioner McKee asked why the conditions were included and if they were a <br /> 18 distraction. He asked what the county would gain or lose. <br /> 19 Chair Bedford said that staff would have to enforce the conditions. <br /> 20 Commissioner McKee said he did not feel it was burdensome. <br /> 21 Cy Stober said a zoning regulation applies to this property in perpetuity until it is amended <br /> 22 by the board at a public hearing. He said if those items remain in as a condition, they would be <br /> 23 enforceable actions, including, for example, if different parties within the HOA invite staff in as an <br /> 24 arbitrator on say a bird house or a trash can. He said staff would be obligated to enforce that <br /> 25 zoning regulation through enforcement methods. <br /> 26 Commissioner McKee asked how the conditions were decided. <br /> 27 Cy Stober said they were provided by the applicant. He said staff did not provide comment <br /> 28 on the conditions except that they looked difficult for staff to enforce. <br /> 29 Commissioner McKee said he was ok with taking them out. <br />
