29 <br /> 1 Commissioner McKee said he has never had a conversation with NCDOT where they <br /> 2 could not tell me what he was going to need or not need. <br /> 3 Commissioner Fowler said she thought NCDOT had already told the applicant that they <br /> 4 don't need the turn lane, but that the applicant is willing to put it in. <br /> 5 Commissioner McKee said it's not on their plans. <br /> 6 Chair Bedford said that NCDOT representatives told them they didn't have to do it, but <br /> 7 that the applicant will do it. <br /> 8 Josh Reinke said NCDOT controls the road so no developer can dictate what they will or <br /> 9 will not do. He said they will request it as part of the driveway permit. He said the reason it is not <br /> 10 shown is because they were told it is not needed. <br /> 11 Commissioner Carter asked if this was a sequencing issue, and that the property needs <br /> 12 to be rezoned first before the permit can be submitted. <br /> 13 Cy Stober said no permits other than the application to rezone have been pulled; not for <br /> 14 water, septic, NCDOT access, driveway access, or for temporary construction access. He said <br /> 15 at this time, none of those departments will confirm that an onsite or offsite improvement is <br /> 16 warranted unless they have the warrant justification by their analysis, and there is no warrant <br /> 17 justification per Chuck Edwards, NCDOT district engineer. He said that Chuck Edwards told him <br /> 18 that a condition to provide both right and left turn lanes would be welcome. <br /> 19 Commissioner McKee asked what assurances that they will have that the turn lanes will <br /> 20 be built. <br /> 21 Cy Stober said he would be responsible, but if NCDOT does not allow them to add turn <br /> 22 lanes then the county could not require it.
