Article 2: Procedures 6 <br /> Section 2.21:stormwater management <br /> Any disputes over determinations regarding Stream Buffer?Authorization Certificates <br /> shall be referred to the Division of Water Resources of the North Carolina Department of <br /> Environmental Quality (NCDEQ)for a decision. <br /> SECTION •R <br /> 2.21.1 Stormwater Management Plan <br /> (A) Application Requirements <br /> (1) A Stormwater Management Plan (SMP) shall be prepared for all Land-Disturbing <br /> Activities subject to this Ordinance whenever the proposed Land-Disturbing <br /> Activity exceeds the stormwater thresholds as defined in the Orange County <br /> Watershed Matrix (Table 4.2.10 of this Ordinance). <br /> (B) Plan Requirements <br /> (1) Any proposed permanent Stormwater Control Measures (SCMs) must be shown <br /> as part of the SMP and must accompany the Land Disturbing Permit (LDP) <br /> application submittal package. SCMs shall meet the requirements of the most <br /> current version of the North Carolina Administrative Code Title 15A, Subchapter <br /> 02H Sections .1000 through .1062, and the most current version of the <br /> Department of Environmental Quality (NCDEQ) Stormwater Design Manual. <br /> (2) All calculations for Nutrient Export (including the nutrient accounting tool), Peak <br /> Run-off Volume, and permanent SCMs designed for Nutrient Removal, as <br /> applicable per the requirements of Section 6.14 of this Ordinance, must be <br /> included in the LDP application submittal package. <br /> (3) SCMs that are designed, constructed and maintained in accordance with the <br /> most current version of the North Carolina Administrative Code Title 15A, <br /> Subchapter 02H, Sections .1000 through .1062 and the most current version of <br /> the NCDEQ Stormwater Design Manual, the approved accounting tools, and the <br /> requirements listed in Section 6.14 of this Ordinance will be presumed to meet <br /> the required performance standards of Section 6.14 of this Ordinance. Submittals <br /> containing measures not designed to these specifications, may be approved on a <br /> case by case basis provided the applicant provides adequate data and <br /> information showing how the deviations meet the requirements of Section 6.14 of <br /> this Ordinance. <br /> (C) Plan Approval <br /> The Erosion Control Officer is authorized to approve any SMP which is in conformance <br /> with the performance standards specified in the most current version of the North <br /> Carolina Administrative Code Title 15A, Subchapter 02H, Sections .1000 through .1062 <br /> and the most current version of the NC DEQ Stormwater Design Manual, and other <br /> requirements of this Ordinance. <br /> (D) Approved Plan a Prerequisite <br /> The Erosion Control Officer is not authorized to issue any LDPs for development on any <br /> land that is defined as new development under Section 6.14 of this Ordinance unless <br /> and until an SMP in compliance with the requirements of this Ordinance has been <br /> approved. <br /> (E) Design of Permanent Nutrient Export Reduction Stormwater Control Measures <br /> When a permanent nutrient export reduction SCM is required for new development to <br /> meet the requirements of this Ordinance, a North Carolina registered professional <br /> engineer shall prepare the SMP with the Engineer's Certification of Stormwater <br /> Management affixed, signed, sealed and dated. <br /> z Correction to our standard form name. <br /> Orange County, North Carolina—Unified Development Ordinance Page 2-66 <br />
