Planning staff have reviewed the materials and agree with a <br /> determination of"Finding of No Significant Impact (FONSI)" as required in Section 2.25.1(B)(5) of the <br /> UDO (Attachment 5). This determination eliminates a requirement from the applicant to provide a more <br /> detailed Environmental Impact Statement (EIS) process as outlined in Sections 2.25.2 and 6.16.4 of the <br /> UDO. <br /> Solid Waste <br /> The applicant will comply with the Orange County Solid Waste Management Ordinance. The applicant <br /> has provided a "Will-Serve" letter from Efland Trash Service for private hauling. Orange County Solid <br /> Waste has confirmed that the proposed road configuration will meet the requirement for recycle material <br /> collection service. <br /> Proposed Conditions <br /> Per NCGS 160D-703, imposed conditions and site-specific standards are limited to those that address <br /> conformance of the development and use of the site to local government ordinances and adopted plans <br /> or the impacts reasonably expected to be generated by the development or use of the site. Per Section <br /> 2.9.1(F)(3) of the UDO, the following conditions are being proposed: <br /> 1. The subject property shall be developed in accordance with the proposed site plan <br /> submitted as part of this application ("Site Plan"). <br /> 2. The minimum lot size is 20,000 square feet. This deviates from the minimum in <br /> UDO Section 3.8. Suitable septic shall be provided on each parcel. <br /> 3. The property shall contain experiential gardens as shown on Site Plan as the <br /> Woodland Garden, the Picking Garden and the Pollinator Garden (the "Gardens"). <br /> The Gardens shall be dedicated to and maintained by the Homeowner's <br /> Association. <br /> 4. Where supplementation of perimeter plantings is required, native plant materials <br /> appropriate for the growing environment in that area shall be utilized. <br /> 5. An ADA-compliant, open-air mail kiosk will incorporate a weather covering with <br /> recessed lighting. <br /> 6. Trails shall provide access to the Designated Community Gathering Space and <br /> each Garden as shown on the Site Plan. The length of the trails located on the <br /> subject property shall combined total at least 9,000 linear feet. Trail surfaces shall <br /> be aggregate or natural surface (not paved with concrete or asphalt) to minimize <br /> impacts to the existing environment and limit impervious surfaces. Boardwalks <br /> shall be utilized where the proposed trail crosses the wetlands as shown on the Site <br /> Plan, if permitted by Federal and State agencies. The trail and associated <br /> amenities described in this section shall be maintained by the Homeowner's <br /> Association. The precise location and alignment of the trails will be determined at <br /> final plat. <br /> 7. The property owner shall offer limited access to the planned trails and open space <br /> to the Eno River Academy for use by students, faculty and staff including the cross- <br /> 8 <br />
