Margaret Lane, Suite 200, Hillsborough, NC 27278 <br /> NORTH CAROLINA 919-245-2575 or plan ningapps(a)orangecountync.gov <br /> Proposed Rezoning and Development Conditions <br /> Case Number: MA25-0003 <br /> In accordance with Section 2.9.1(F), Approval and Conditions, applicants may submit voluntary conditions which <br /> are to be reviewed by the Board of County Commissioners for a determination as to whether such conditions will <br /> afford protection of the public health, safety, and general welfare. Describe in detail any proposed conditions <br /> proposed as part of the conditional rezoning request. Attach additional pages as needed. <br /> Proposed Zoning Conditions Date <br /> (Including Revisions <br /> The subject property shall be developed in accordance with the proposed site plan <br /> 1. submitted as part of this application ("Site Plan"). 10-22-2025 <br /> The minimum lot size is 20,000 square feet. This deviates from the minimum in UDO <br /> 2. Section 3.8.Suitable septic shall be provided on each parcel. 10-22-2025 <br /> The property shall contain experiential gardens as shown on Site Plan as the Woodland <br /> Garden, the Picking Garden and the Pollinator Garden (the "Gardens").The Gardens shall <br /> 3. 10-22-2025 <br /> be dedicated to and maintained by the Homeowner's Association. <br /> Where supplementation of perimeter plantings is required, native plant materials <br /> 4. appropriate for the growing environment in that area shall be utilized. 10-22-2025 <br /> An ADA-compliant, open-air mail kiosk will incorporate a weather covering with recessed <br /> 5. lighting. 10-22-2025 <br /> Trails shall provide access to the Designated Community Gathering Space and each Garden <br /> as shown on the Site Plan. The length of the trails located on the subject property shall <br /> combined total at least 9,000 linear feet. Trail surfaces shall be aggregate or natural <br /> surface (not paved with concrete or asphalt)to minimize impacts to the existing <br /> 6 environment and limit impervious surfaces. Boardwalks shall be utilized where the 10-22-2025 <br /> proposed trail crosses the wetlands as shown on the Site Plan, if permitted by Federal and <br /> State agencies. The trail and associated amenities described in this section shall be <br /> maintained by the Homeowner's Association. The precise location and alignment of the <br /> trails will be determined at final plat. <br /> The property owner shall offer limited access to the planned trails and open space to the <br /> Eno River Academy for use by students, faculty and staff including the cross-country team <br /> 7. pursuant to an agreement drafted by the landowner with an effective date after 10-22-2025 <br /> construction is complete. <br /> The Designated Community Gathering Space as shown on the site plan to be maintained <br /> 8. by the Homeowner's Association. 10-22-2025 <br /> 178390495.1 <br />
