All parcels with structures located within flood prone areas now have a notice on them <br />within the Building Inspection permit system, so that no improvements or additions are <br />allowed unless flood and the builder provides first floor elevation data.. <br />8. Both the Planning Department and County libraries have books, pamphlets, and <br />brochures on the NFIP and flood proofing buildings, <br />To continue with the CRS process, the FEMA representative requested that the county forward <br />a draft copy of the proposed revisions to the present flood damage prevention ordinance, <br />administrative procedures to process building permits, which involve structures in or very near <br />floodplain areas, and a listing of residences built in floodplain areas since 1981, <br />COMMENTS FROM MAY 2004 QUARTERLY PUBLIC HEARING: <br />1. On page 27, what are petroleum products? How about plastics which are derived <br />from petroleum and shouldn't we include PCBs? Should we differentiate between <br />recycled and treated wood? <br />Section 42-91 General Standards 12, is revised to include not only PCBs and delete any <br />petroleum product, but also add to "Gasoline" "and other petroleum products" and also list <br />Polychlorinated biphenyls (PCBs), Polynuclear aromatic hydrocarbons (PAHs), Volatile <br />Organic Compounds (VOCs), and "any priority pollutants listed in Table 1 of Section 307 of <br />the Clean Water Act (PL 92-500), as amended. <br />2. Does the State allow development in the floodplain? Are we precluded from <br />banning any new construction in the floodplain? <br />No, Orange County is not precluded from banning new construction in Special Flood Hazard <br />Areas, Section 42-92 Special Standards; Subsection 1 is revised to state, "New <br />Constnuction within the SFHA shall be prohibited, Substantial improvement of any existing <br />residential structure ...". Subsection 2 is revised to state, "New Construction within the <br />SFHA shall be prohibited, Substantial improvement of any existing commercial, industrial, or <br />other non-residential structure ..,". <br />3. How would the New Farmers' Market on County Property in Hillsborough be <br />affected? <br />The proposed pavilion is not an enclosed structure. Therefore, it could be built within a <br />flood-prone area so long as all electrical service and water and sewer facilities are elevated <br />two feet above the base flood elevation (509' msl), <br />4. On page 5, what does the term "common usage" mean? <br />It is generally accepted legal wording used to say that any term or phase in the ordinance, <br />which are not defined, would be given their common usage definition in the interpretation of <br />the regulations. <br />5. We need to prohibit compounds being stored in the floodplain and place any <br />outright prohibition of new uses. <br />See items #1 and #2 above, <br />6. Is there a difference between the terms "floodplain" and "flood prone?" Are the <br />two interchangeable? The terms floodplain, flood fringe, and 100-year flood <br />should be given definitions and illustrations for better understanding. <br />Staff has added a definition for flood fringe and the definitions of floodplain and has <br />expanded the 100-year flood definition. <br />
