Fox Hill Farm East Phase 2 is located on the east side of New Sharon Church Road, <br />Eno Township. The Board approved the preliminary plat for Fox Hill Farm - East Phase 2 Section <br />A & B on June 6, 2000, stipulating in its resolution of approval that "Country Air Lane, Butterfly <br />Place, Fernleaf Place, Rosebriar Place and Highbranch Way shall be irrevocably dedicated to the <br />general public and be constructed to the standards of the North Carolina Department of <br />Transportation ", that Orange County accept the dedication to the general public (of the rights -of- <br />way for those roads) without maintenance responsibility, and that the owner /applicant maintain <br />those roads "until such time as they are accepted for maintenance by the North Carolina <br />Department of Transportation or some other governmental body." The Board, in June 2005, <br />approved the developer's petition to add other roads in the subdivision (Country Air Lane, Butterfly <br />Place, Fernleaf Place, North Highbranch Way and South Highbranch Way) to the State Secondary <br />Road Maintenance Program. The developer did not include Rosebriar Place in the previous <br />petition because, at that time, Rosebriar Place lacked the required density of occupied homes to <br />meet the NCDOT requirements for public road maintenance.. <br />NCDOT has investigated the request (please refer to attached Secondary Road Addition Report), <br />and has submitted the petition to the Board of Commissioners for its review and approval. The <br />Board must take an administrative action to approve the petition to NCDOT in order for NCDOT to <br />add Rosebriar Place to the State Secondary Road System, and accept maintenance <br />responsibilities. <br />FINANCIAL IMPACT: There is no direct financial impact associated with this item. <br />
