23

Slide #24 1
2
Christopher Sandt said the darkest green color indicates the watersheds with the most 3
restrictive impervious area restrictions. He said only 6% of a parcel may be impervious there. 4
Next, the medium green areas are 12%. He noted that the state requires only a 12% limit. 5
Commissioner McKee said the 6% impervious surface restriction creates a hardship for 6
anyone who is stressed financially. On a one-acre lot, there are only 2,500 square feet that must 7
include the driveway, deck, and any other impervious area, including the rooftop. He said the limit 8
is 12000 feet on a two-acre lot, which may sound like a lot, but isn’t. 9
Christopher Sandt said it restricts denser multi-family development. He clarified that 10
people could get approved for up to a 3% bump on the 6% requirement if they install a stormwater 11
control measure that treats the 3% balance. However, he agreed with Commissioner McKee that 12
it is very tough to build a house with a long driveway and try to keep the impervious surfaces 13
under 6%. 14
Commissioner McKee said the difference in impervious surface requirements creates an 15
equity issue across the county. 16
Cy Stober said all the base level impervious allowances allow for a 3% additional footprint 17
with the installation of stormwater control measures. 18
Commissioner McKee asked Cy Stober to explain stormwater control measures. 19
Cy Stober said stormwater control measures are engineered devices designed to intercept 20
all runoff from any paved area on a property and treat it for volume and sediment, and now 21
nitrogen and phosphorus under the Falls Lakes rules. 22
