Notices were mailed to <br /> 388 property owners within 1,000 feet of the parcel on July 23rd,two weeks before today's meeting, as <br /> 389 well as signs were posted on the subject property and the application information was posted on <br /> 390 our Active Development Page available on our website. We did complete staff analysis and <br /> 391 determined that the application was complete and in accordance with requirements of the UDO. <br /> 392 We looked through the Zoning Atlas and Unified Development Ordinance and in that section of <br /> 393 what's required there as well as specifically for Conditional Districts, and our specific use <br /> 394 standards that relate to Major Subdivision Conditional Districts. We included how consideration <br /> 395 thinking about how the request relates to the Orange County Comprehensive Plan and we <br /> 396 determined that it is consistent with the 2030 Comprehensive Plan,Appendix F,the use that's <br /> 397 requested for the Residential-Conditional District is found in the consistent land-use <br /> 398 classifications. The applicant also provided an Environmental Impact Assessment, and staff <br /> 399 reviewed and determined that there are no significant environmental impacts expected from this <br /> 400 project based on existing conditions.This is where we are at tonight. We are requesting the <br /> 401 Planning Board hear from the applicant, staff, and public, review and discuss analysis and the <br /> 402 staff recommendation, and then recommend approval or denial to the Board of County <br /> 403 Commissioners. Our recommendation as staff is that you receive the rezoning application, <br /> 404 deliberate on the proposal as desired, consider the Planning Director's recommendation, which is <br /> 405 to make a recommendation to the BOCC on the Statement of Consistency or Inconsistency, and <br /> 406 my apologies for the error,that one is all on me, and review the proposed ordinance and make a <br /> 407 recommendation in time for the October 7th BOCC meeting. And so, I'll turn it back to you for <br /> 408 your questions. <br /> 409 <br /> 410 Lamar Proctor: All right. Thank you. <br /> 411 <br /> 412 Delores Bailey: Yes, good evening. Let me just say that we've received several letters in opposition to this, so I'm <br /> 413 trying to get to the bottom of that. Can you tell me from the well was drilled? You mentioned the <br /> 414 well that's a thousand feet down. When was that drilled? <br /> 415 <br /> 416 Beth Trahos: Let me ask. November. <br /> 417 <br /> 418 Delores Bailey: So, is this already started? Or done? Has this project already started, and we're just agreeing to <br /> 419 it? <br /> 420 <br /> 421 Beth Trahos: No. The well was dug to get an understanding of the capacity, and having the well dug also <br /> 422 allowed for the additional testing that was done and analysis based on comments received from <br /> 423 the community, so, it was to understand what is achievable here. <br /> 424 <br /> 425 Delores Bailey: It just seemed per the letters that it felt like y'all had already started on this, and this is going to <br /> 426 happen regardless. <br /> 427 <br /> 428 Beth Trahos: No, ma'am. We,of course, cannot do that unless the county allows us to. But we wanted to be <br /> 429 sure if the county would allow us to that we would have capacity necessary. And drilling a well is <br /> 430 a significant investment. <br /> 431 <br /> 432 Delores Bailey: And is the mall kiosk already up? <br /> 433 <br /> 434 Beth Trahos: No, ma'am. <br /> 435 <br /> 436 Delores Bailey: Okay, that's planned. A couple things about the well. Somebody said that you didn't feel like it <br /> 437 would have an impact on the current wells. So, I'm concerned about that.
