5

Tom Altieri said one of the early deliverables from Clarion Associates was the Fact Book, 1
which includes the information that has been presented so far. The Fact Book is available on the 2
following website: https://www.orangecountylanduseplan.com 3
Commissioner Portie-Ascott asked about the data source, specifically mentioning updated 4
information from the North Carolina Association of County Commissioners. 5
Cy Stober, Planning and Inspections Director, said he’s happy to look at the data from 6
NCACC to compare. He said the Fact Book is a living document and is intended to be updated 7
as needed. 8
Chair Bedford requested clarification on the requirements for annexation. 9
Tom Altieri said that the practice of forced annexation, which allowed municipalities to 10
annex areas meeting specific development criteria, ended 10-11 years ago. This previous process 11
permitted municipalities to forcibly annex areas if they demonstrated certain developmental 12
thresholds, like certain densities of commercial or residential development. The change in the law 13
means that now annexation predominantly operates on a petition-based system. He explained 14
that under this system, developers must request connections to municipal utilities to initiate the 15
process of annexation. If such a utility request is absent, moving forward with annexation 16
becomes challenging, requiring the consent of 60% of the area's property owners. 17
Cy Stober said annexation necessitates agreement from 80% of every voting-age member 18
residing in the area in question, not just 60% of property owners. 19
Commissioner Carter asked if the Fact Book incorporated household data. 20
Tom Altieri confirmed limited household data in the Fact Book but noted staff 21
supplemented tonight's presentation with additional sources. 22
23
Slide #5 24
25 26
27
28
