Approved 9.3.25
bedroom count, and trying to make sure it fits within what are the requirements of Orange
County's environmental health department and assuming a lower LTAR value. Which is what we
call for the loading rate, so we assume, I believe, a .25,which is on the low end of a conventional
soil. And then we documented in there what was the type of systems we were assuming. We're
assuming 3-foot trench systems. You can use gravel trench. You can use innovative systems like
easy-flow or infiltrator or TNJ panel, which are panel systems. So,we are able to fit on all four of
those four-bedroom lots.

Lamar Proctor: Okay.

Cy Stober: Mr. Chair?

Lamar Proctor: Yes.

Cy Stober: If I may? Just a reminder for the public as well as the board. Regardless of whether the proposal
tonight or application tonight is recommended for approval or denial and regardless of whether it
ultimately is approved or denied by the Board of Commissioners, that is no assurance of
Environmental Health permitting, which is a separate process, so all of the septic systems would
have to be permitted by the county and will be at the discretion of the Environmental Health
Department.

Lamar Proctor: That will that be permitted per lot, right?

Cy Stober: Correct.

Lamar Proctor: So, it could end up that there are only 40 lots or.

Statler Gilfillen: Or 20.

David Barcal: Yeah. And when you get to a detailed soil analysis, and you actually get boots on the ground and
lay out the actual lines with the house boxes that are proposed.

Chris Johnston: But then at that point, it would be potentially a change in the conditional use, and if any changes
had to occur, they'd have to come back to submitting a new plan? Or are there variances that are
allowed if this site doesn't perc right or whatever the case may be.

Cy Stober: There are minor modifications permitted to me as the director to make administrative levee. They
largely are shifting locations of commitments like their mail kiosk or some of their amenities. We
can modify some of the lot dimensions, provided they don't totally change the layout. But if they're
not able to fulfill the lot and they fall short of the lot count, that is really a more of a subdivision
matter at that point, and they have the approval for up to, in this case,40 lots. But if you can't
fulfill that then that would be where they're at. The lots that they're able to permit.

Chris Johnston: So, their options would be to only have the number of lots that they could permit based on the
septic systems, or if they wanted to readjust it in such a way that it exceeds your variance
allowance, they'd have to then submit again for.

Cy Stober: Yeah, if it fundamentally alters the character and the layout and design of the subdivision, the
cluster subdivision in this case, they would have to go back through the hearing process.

Lamar Proctor: And then I didn't see anything about lighting conditions. I know that one of the important things in
White Cross and in rural Orange County is light pollution, so you're going to have 40-plus potential
homes. Are there any ideas or conditions that were discussed as to lighting to minimize light
pollution?
