59 <br /> proposes a 75-ft wide setback between the normal pool of Lake Orange and the proposed <br /> residential structure, a minimum 30-ft wide building setback between the Eno Cemetery <br /> Road right-of-way line and the proposed residential structure, and a minimum 100-ft wide <br /> setback between the normal pool of Lake Orange and the proposed private septic <br /> tank/drainfield. The proposed private water well will be located a minimum of 50-ft from the <br /> proposed private septic tank/drainfield. <br /> The project parcel was platted/recorded on April 11, 1974. UDO Section 4.2.2(I)(1) defines <br /> an existing lot as a lot which was created prior to January 1, 1994. UDO Section 4.4.4(I)(2) <br /> further defines that stream buffers and septic system setbacks may be reduced to the <br /> extent necessary to allow for the development of a parcel qualified as an existing lot, <br /> provided that all of the following criteria are met: <br /> a) The septic system is sized to serve no more than two bedrooms; and <br /> b) The septic tank, drainfield and repair area (where required) can be accommodated <br /> on 20,000 square feet of area or less; and <br /> c) The Orange County Planning Department, in consultation with Orange County <br /> Environmental Health and/or the Orange County Engineer has determined that <br /> encroachment of the residential structure and/or the septic system or repair area into <br /> the stream buffer or reservoir setback is necessary to provide adequate area for <br /> septic disposal and repair while maintaining required separations between wells, <br /> septic systems, structures and property lines; and <br /> d) The Orange County Planning Department, in consultation with Orange County <br /> Environmental Health and/or the Orange County Engineer, has determined that the <br /> relative locations of the well, septic system and residential structure maximize the <br /> amount of watershed protection that can be achieved while allowing development of <br /> the lot. Generally, an exception to setbacks for septic repair area is preferable to an <br /> exception for the initial septic system. <br /> Conclusion: <br /> The County Engineer has determined that PIN 9857-65-5080 qualifies as an existing lot as <br /> defined in UDO Section 4.2.2(I)(1). The County Engineer has further determined that the <br /> requested reductions to the required reservoir setbacks and the required front setback are <br /> necessary to provide adequate area for septic disposal and that the locations of the <br /> proposed well, septic system, and residential structure have maximized to the best extent <br /> practicable the amount of watershed protection that can be achieved while also allowing <br /> by-right development of the existing lot.
