51 <br /> Exhibit CA — Requested Relief <br /> ❑ I request that the determination, order, or permit attached as Exhibit B be vacated. <br /> ❑✓ I request that the determination, order, or permit attached as Exhibit B be modified as follows: <br /> That a variance to the front yard setback from 40 feet to 30 feet (as recommended by Orange County <br /> Planning staff) <br /> Exhibit C.2 — Applicant Argument and Reasoning <br /> This property was created in 1976 (per plat book 26 page 85) as part of the Harold E. Walker <br /> Subdivision, which was prior to the 1994 zoning ordinance requiring a 150 foot reservoir buffer and <br /> 300' septic setback. As such these lots were not created with these buffers in mind. Fortunately since <br /> the proposed project will have 4 or less bedrooms (2 bedrooms are proposed) and the septic areas is <br /> less than 20,000 square feet the Orange County Planning Department can administratively reduce <br /> the 150' reservoir buffer to 75' and according to Orange County Environmental Health due to the age <br /> of the creation of the lot the 300' septic setback can be reduced to 100'. Even with these <br /> administrative reductions the lot still needs a variance because the depth of this lot is only 137.87'/ <br /> 140' (north side and south side respectively), the front width is 155.59' and the lake side width is 156. <br /> 49 feet. As shown on the attached Exhibit D with the 40' setback there isn't sufficient room to <br /> construct a reasonably sized habitable structure (with associated septic field and well) once you apply <br /> the 50 foot setback from the adjacent well, the 75 foot reservoir setback, 100 foot septic reservoir <br /> setback and required offsets for the septic areas. <br /> (attach additional sheets as necessary) <br /> Variance* <br /> Exhibit B — Explanation of Hardship <br /> To qualify for a variance, the applicant must make four showings.
