Water and Sewer Service: The property is not located within a <br /> primary utility service area meaning water and sewer service is <br /> provided by an individual well and septic system. <br /> Surrounding Land Uses: a. NORTH: Single-Family Dwelling, zoned AR; <br /> b. SOUTH: Single-Family Dwelling, zoned AR; <br /> c. EAST: Single-Family Dwelling, zoned AR; <br /> d. WEST: Lake Orange. <br /> Proposal: As detailed within Attachment 1, the applicant has applied for a VARIANCE from the <br /> required 40-foot front building setback applied to the Eno Cemetery Road right-of-way to allow <br /> for the construction of a new residential structure. The applicant is also seeking an <br /> administrative reduction in the 150-foot reservoir setback to 75 feet under section 4.2.2.(I)(2), <br /> which allows for "Existing Lots" to encroach upon established "stream buffers" and "setbacks for <br /> septic systems" if meeting the necessary criteria. This variance will provide relief from the <br /> standard 40-foot front setback for new structures located in the AR zoning district. <br /> Should a Variance be granted, all construction activity would be required to obtain proper <br /> permitting through Orange County. <br /> ORDINANCE REQUIREMENTS: <br /> Per Section 3.3 Residential Districts development project(s) within the AR Zoning District are <br /> required to adhere to the following setback requirement(s): <br /> a. 40-foot minimum front setback from ROW; <br /> b. 40-foot minimum corner side setback; <br /> c. 20-foot minimum side setback; <br /> d. 20-foot minimum rear setback. <br /> STAFF COMMENT(S): <br /> 1. The application has been deemed complete. <br /> 2. As required under Section 2.12.6 of the UDO, staff notified all property owners within <br /> 1,000 feet of the subject property of the variance request. This notice also informed <br /> parties of the date, time, and location of the public hearing where the request will be <br /> reviewed. Copies of the letter, as well as our certification of mailing, are contained in <br /> Attachment 4. <br /> 2 <br />
