All in favor. <br /> 13 <br /> 14 Leon Meyers: The December 11th meeting minutes are approved. <br /> 15 <br /> 16 AGENDA ITEM 4: PUBLIC CHARGE <br /> 17 <br /> 18 AGENDA ITEM 5: Potential BOA Conflict of Interest Statement <br /> 19 <br /> 20 Leon Meyers: Folks if you'll bear with me, I'm going to read the public charge here. The Board of Adjustment <br /> 21 pledges to the citizens of Orange County its respect. I'm sorry? <br /> 22 <br /> 23 Audience: We can't hear you. <br /> 24 <br /> 25 Leon Meyers: Can't hear me. Okay. The board asks its citizens to conduct themselves in a respectful courteous <br /> 26 manner, both with the board and with fellow citizens. At any time should any member of the board <br /> 27 or any citizen fail to observe the public charge, I'll ask the offending person to leave the meeting <br /> 28 until that individual regains personal control. Should decorum failed to be restored, we'll recess the <br /> 29 meeting until a time when a genuine commitment to this public charge can be observed. Now is a <br /> 30 good time to turn off devices if you haven't done so already. The Board of Adjustment is a quasi- <br /> 31 judicial administrative body established in accordance with local regulations, the UDO and state <br /> 32 law to perform specified functions essential to the county's planning program including issuing and <br /> 33 modifying special use permits, which is the subject of this evening's hearing. Actions taken by the <br /> 34 board or based solely on competence, substantial, and material evidence presented during a <br /> 35 previously scheduled and advertised public hearing on a specific item. As detailed within Section <br /> 36 2.12.2 of the UDO. The board reserves the right to exclude evidence and testimony that is <br /> 37 deemed incompetent, irrelevant, immaterial, or unduly repetitious and therefore, fails to reasonably <br /> 38 address the issues before the Board of Adjustment. While it should be noted that there's no time <br /> 39 limit on the presentation of evidence, I will ask that the presentation of evidence be consistent with <br /> 40 established polices and just ask if folks be as brief as possible. Regarding potential conflicts of <br /> 41 interests, it's the duty of every board member to avoid both conflict of interest and appearances of <br /> 42 conflicts. Board members having any conflicts of interest or appearances of conflict related to the <br /> 43 matters before the board should identify the conflict or appearance of conflict and refrain from <br /> 44 participation in the hearing. As a reminder, General Statute 160D109 establishes this standard. A <br /> 45 member of any board exercising quasi-judicial functions pursuant to this chapter, shall not <br /> 46 participate in or vote on any quasi-judicial manner, matter in a manner that would violate affected <br /> 47 persons constitutional rights to any partial decision maker. And permissible violations or due <br /> 48 process include but are not limited to a member having a fixed opinion prior to the hearing <br /> 49 undisclosed ex parte communications, a close familial business or other associational relationship <br /> 2 <br />
