So, we're a very close neighborhood.And it's <br /> 11 impossible to get together this kind of evidence that you want in 10 days. You know, I want to say <br /> 12 one thing, I notice that Mr. Patil put in his application on, I think it was March 18th of this year, so <br /> 13 they had plenty of time to have an attorney work for them. <br /> 14 <br /> 15 Beth Bronson: Because again, he is the applicant. I understand where you're coming from but the fact that he is <br /> 16 the applicant who is applying for this special use permit, he would be very aware of the timing of <br /> 17 when he had to make that application for it to be presented to the Board of Adjustment for a special <br /> 18 use permit. <br /> 19 <br /> 20 Leslie Weidner: So, Mr. Patil is more important than all these people? <br /> 21 <br /> 22 Beth Bronson: No, Mr. Patil is the applicant. He has done what is necessary. Again, I'm absolutely not showing <br /> 23 preference over one party or the other. <br /> 24 <br /> 25 Leslie Weidner: Understand. <br /> 26 <br /> 27 Beth Bronson: I'm simply pointing out that when an applicant files for, a special use permit, they have to do so <br /> 28 well before the date of its actually being presented so that anybody within 500 to 1,000 feet can be <br /> 29 mailed notice or that can be provided. Now, that is part of the development ordinance, that timing. <br /> 30 1 may not agree with it either, but the timing is what it is and it's what's written down. <br /> 31 <br /> 32 Leslie Weidner: Yeah. <br /> 33 <br /> 34 Beth Bronson: And so, the fact that, there is no representation by the neighborhood except for in the instance of <br /> 35 the original speaker. I couldn't move forward with standing. <br /> 36 <br /> 37 Leon Meyers: Okay. Everybody had a chance to look at the statement from Weidner. <br /> 38 <br /> 39 Jeff Scott: Does Patrick, I guess he was saying that the applicant needs to speak before we make the motion, <br /> 40 is that right, or did I miss something? <br /> 41 <br /> 42 Leon Meyers: Well, the current motion is regarding standing for Ms. Weidner. I believe what Pat said was a <br /> 43 suggestion that if we were going to make a decision about the hearing. <br /> 44 <br /> 45 Jeff Scott: Okay. <br /> 46 <br /> 47 Patrick Mallett: Balancing out the discussion time and the facts on just this front part, the establishment of legal <br /> 48 standing.
