10 Draft <br /> 1 <br /> 2 Jeff Scott: Could I make,just ask one more question. <br /> 3 <br /> 4 Leon Meyers: Please. <br /> 5 <br /> 6 Jeff Scott: Between the Board and the County, when we see the letter that gets mailed to the neighbors <br /> 7 spelling out when the meeting is going to take place, there isn't any mention of establishing <br /> 8 standing in that letter. So, my question would be is that, there's mention of a meeting, it says come <br /> 9 to the meeting if you want to attend, but there is no mention of saying 2 weeks, you get 2 weeks to <br /> 10 kind of bring you back and that's what I'm concerned about like, we're not giving everybody a full <br /> 11 picture of what they can and can't do within 10 days or 25 days. <br /> 12 <br /> 13 Leon Meyers: What's your thought, Pat, on that topic? <br /> 14 <br /> 15 Patrick Mallett: So, in accordance with state law and our UDO, we give the proper notification requirements that <br /> 16 includes a letter. It states the date, time of the event and the general nature of the event. I have <br /> 17 met with two, three of the owners, adjacent owners that are here tonight. I did deliver a digital copy <br /> 18 and hard copy of the Statement of Standing material, went through that and explained, "This is <br /> 19 something you need to disseminate to the neighborhood." Now, whether that information got to <br /> 20 every person in this room, I don't know, but it's a bit of a slippery slope because that may or may <br /> 21 not be germane to all the people that are notified within 1,000 feet or they may not care, but point <br /> 22 taken, we're not required to do that. <br /> 23 <br /> 24 Jeff Scott: Yeah, and I asked because I know we deal with this a lot, obviously. <br /> 25 <br /> 26 Patrick Mallett: And to be honest, we're doing our best to formalize and codify that because of the discussions like <br /> 27 this but the bottom line is it's up to the board to establish that legal standing in accordance with <br /> 28 state law. <br /> 29 <br /> 30 Michael Hugelmeyer: Ladies and gentlemen, can I just add one thing? This is, the gentlemen here just said it's within <br /> 31 1,000 feet, etc., this is a dead-end street, and it's happening at the beginning of the dead-end <br /> 32 street, so regardless of who is immediately affected, it affects everyone because everybody has to <br /> 33 drive down the road. This is a very important point. If we have the entire road here asking for a <br /> 34 continuation based on the fact, Jeff, that we were not sufficiently told, essentially, you need to have <br /> 35 all your ducks in a row in order to be here, I would hope based on what we have going on here it <br /> 36 would be appropriate to suggest at least a continuation is appropriate. <br /> 37 <br /> 38 Leon Meyers: I just want to correct you by saying that Pat just testified, that the notice that the statute and the <br /> 39 UDO require did get sent in the time when the UDO and the statute were sent. Whether that's <br /> 40 good policy or not is another matter, but those are the rules that we're operating under for tonight's <br /> 41 hearing. <br /> 42 <br /> 43 Michael Hugelmeyer: Based on rules that you're operating under if you see that they're good or not, maybe that <br /> 44 could have an influence as to whether there's at least a continuation for this evening. <br /> 45 <br /> 46 Leon Meyers: Right. <br /> 47 <br /> 48 Michael Hugelmeyer: Thank you. <br /> 49 <br /> 50 Leon Meyers: The two topics here, I believe, Nathan, you were saying that Mr. Hugelmeyer's standing would be a <br /> 10 <br />
