Approved 8.7.24 <br /> <br />this development is on Morrow Mill and Goldmine Loop. Emergency road is going to 1402 <br />come out right in front of my daughter's house and my soon to be fourth grandchildren. 1403 <br />Come out and please drive down Goldmine Loop, it still has gravel on it, it's still a gravel 1404 <br />road in places. So, we moved out there to be in a rural area, rural community, and all 1405 <br />those people along Goldmine Loop. They're going to put 300 people on 30 acres and no 1406 <br />offense to them, but they're saying that the other 60 acres, two-thirds of this is going to be 1407 <br />less forested. We all know that cannot happen. You cannot put a road in there, you 1408 <br />cannot put sidewalks in there, berms in there, storm water drainage, and if they can dig a 1409 <br />well there that gets 40 gallons a minute, they need to go into the well drilling business, 1410 <br />because I've never heard of that before, that's not happening out there. I was not 1411 <br />opposed to this initially; I just was listening with an open mind. Thanks for listening. I'm 1412 <br />not as eloquent as all these other people but this is going to affect our lifestyle, 10 years 1413 <br />of construction, please, 10 years. Item 1426 <br />8, in regard to how it, and I'm sorry, I'm used to looking at Cy and then Cy looks back at 1427 <br />me, who am I looking at here today in terms of talking about Item 8? This is the one 1428 <br />where we need to be in alignment with state law. Is that an accurate representation or is 1429 <br />that an inaccurate representation? 1430 <br /> 1431 <br />Charity Kirk: The family care, care facilities and, and master planning district. 1432 <br /> 1433 <br />Lamar Proctor: It's Agenda Item No. 8. 1434 <br /> 1435 <br />Perdita Holtz: So, the UDO text amendment, it's in the abstract. When we were researching it, we 1436 <br />determined that state law requires that you cannot discriminate against family care homes 1437 <br />if they're allowed in any residential area, they need to be allowed in all the residential 1438 <br />areas or in a zoning district that allows residential, which MPD-CD does. It was an 1439 <br />oversight when MPD-CD was created back in 2010 to not have the little star there 1440 <br />indicating that you can apply for that. So, even if that text amendment does not get 1441 <br />approved at this point, at some time staff will be back to add that tick mark to that. 1442 <br /> 1443 <br />Chris Johnston: But to confirm, tonight, this is in front of us, to put us into alignment with state regulations. 1444 <br />One way or another this has to occur unless we do what? There is no unless we do what, 1445 <br />correct? 1446 <br /> 1447 <br />Perdita Holtz: The text amendment, that stipulation, has multiple parts in the UDO. The part that I just 1448 <br />described about having a little star in the table of permitted uses is the one thing that will 1449 <br />have to occur at some point, whether it's part of this action or whether it's part of a future 1450 <br />action initiated by staff. 1451
