The <br />proposed rezoning is: <br />FROM: R-1 (Rural Residential) <br />TO: R-CD (Residential - Conditional District) <br />BACKGROUND: A Conditional Zoning Atlas Amendment application (Attachment 1) was <br />received from Forestar Group, Inc., on behalf of Carolyn Rigsbee, proposing to rezone <br />approximately 61.11 acres of property at 3531 NC Highway 54 W, Chapel Hill to allow for <br />development of a 43-lot conservation cluster subdivision for single-family dwellings. All <br />application materials can be found on the Orange County Permit Portal. The Staff Report in <br />Attachment 2 contains additional information, maps, and analysis with regard to the application’s <br />consistency with County adopted plans. Approval of a site-specific plan is part of the conditional <br />district rezoning process, and the site plan and any agreed-upon conditions are binding to the <br />development permitted for the zoning district. <br />Basic Review Process: A conditional district rezoning application requires submission of a site <br />plan and other documents, in accordance with Section 2.9.1(C) of the Orange County Unified <br />Development Ordinance (UDO). Sections 2.8 and 2.9 of the Orange County UDO require the <br />following review: <br />•FIRST ACTION – Applicant holds a Neighborhood Information Meeting (NIM). <br />17
