26 <br />Any period of absence to receive multiple treatments (including any period of recovery there from) by <br />a health care provider or by a provider of health care services under orders of, or on referral by, a <br />health care provider, either for restorative surgery after an accident or other injury, or for a condition <br />that would likely result in a period of incapacity of more than three consecutive calendar days in the <br />absence of medical intervention or treatment, such as cancer (chemotherapy, radiation, etc.), severe <br />arthritis (physical therapy), and kidney disease (dialysis). <br /> <br />Family Leave Defined. What is a Family Leave of Absence? A Family Leave of Absence under the Family <br />and Medical Leave Act may be permitted: <br /> <br />1. For the birth of a son or daughter of the employee and to care for the newborn child. <br />2. For placement of a son or daughter with the employee for adoption or foster care. <br />3. To care for the employee’s spouse, son, daughter, or parent who has a Serious Health Condition <br /> <br /> <br />Medical Leave Defined. What is a Medical Leave of Absence? A Medical Leave of Absence under the <br />Family and Medical Leave Act may be granted to an eligible employee because of a Serious Health Condition <br />that makes the employee unable to perform the essential functions of his or her job. <br /> <br />Notice and Application Procedure for Family and Medical Leave. Upon notice and application to the <br />company, a Family and Medical Leave of Absence, or renewals thereof, shall be granted to employees who <br />submit medical certification and/or other information verifying eligibility, according to the following <br />procedure: <br /> <br />1. Notice and application for a Family or Medical Leave of Absence may be given either orally or in <br />writing. Where practical, notice and application should normally be made on provided leave forms <br />that are available. Where foreseeable, it must be given 30 days prior to the beginning of the requested <br />leave. In other situations, it must be give within a reasonable time, generally not more than one or two <br />days after the need for leave becomes known to the employee. The application and any renewal or <br />extension forms shall state the anticipated duration of the leave. <br /> <br />2. We require all employees seeking Family and Medical Leave to provide medical certification of the <br />reason for the absence. You will be provided the Medical Certification form when you notify the <br />company of your need for Family and Medical Leave. This form must be returned within 15 calendar <br />days. The granting of Family and Medical Leave absences prior to your providing the completed <br />Medical Certification form is conditional. If such certification of verifying information and <br />documentation is not timely received after it is requested, the conditional leave will be void; the leave <br />will be denied, retroactive to its first day. Second and third medical opinions may be requested as <br />permitted by law, at our expense, to further validate the employee’s certification. <br /> <br />3. Such information and documentation verifying entitlement to a Family or Medical Leave for the <br />birth/care or placement of a son or daughter, as we may request, must be provided by the employee. <br /> <br /> <br />General Family and Medical Leave Provisions: <br /> <br />1. The maximum total amount of time available to an eligible employee for Family and Medical Leave <br />of Absence is twelve (12) workweeks during the rolling twelve (12) month period measured backward <br />from the date leave is used. A workweek for purposes of this policy generally consists of five (5) <br />eight- (8) hour workdays.
