Article 4: Overlay Zoning Districts 19 <br /> Section 4.2:Watershed Protection Overlay Districts2F <br /> (7) The property owner, at its cost and expense, shall be required to execute and file <br /> with Orange County a Performance Guarantee to cover the cost of removal of a <br /> SCM, and any additional impervious surface area installed as the result of its <br /> approval, in the event the SCM is failed to be maintained in accordance with the <br /> recorded operations agreement. The Performance Guarantee shall comply with <br /> the provisions of Section 6.22 of this Ordinance. <br /> (E) Through qualification as a moderate- or low-income household, based on current <br /> Department of Housing & Urban Development(HUD)criteria, specified as follows:75 <br /> (1) For residential development, up to a 50% impervious surface ratio may be <br /> granted for households earning between 60% and 80% of HUD median <br /> household income. <br /> (2) For residential development, up to a 70% impervious surface ratio may be <br /> granted for households earning less than 60% of HUD median household <br /> income. <br /> "� <br /> (E) if all of the criteria of Section 4.2.4(A) are satisfied, an applicant may elect to apply thee <br /> preexisting development regulations, as specified in Section 6 14(C) 76 <br /> 75 This is a new subsection created to allow for modifications to the allowable impervious surface ratio for low to <br /> moderate income residential households in the County. <br /> 76 The previous/legacy subsection E will be moved to the end of Section 4.2.4—its previous/legacy location is <br /> erroneous and confusing to the reader. <br /> Orange County, North Carolina—Unified Development Ordinance Page 4-16 <br />
