Hadler, Esq.
Beemer Hadler &Willett PA
Alan Dorman
Director, Asset Management Services
Orange County
RE: BOCC Questions
Date: June 30, 2025
Response to BOCC Questions:
By way of background, the Declaration and Bylaws were drafted as a product of a workgroup
that was formed in late summer 2023. The members of the workgroup were from the County
and Town. The County representatives were Steve Arndt, Alan Dorman, and Erin Sapienza. The
Town representatives were JC Ferguson, Jon Hartman-Brown, and Ben Schmadeke. During the
sequence of four (4) meetings between October 5, 2023, and May 7, 2024, Keith Berger (Town),
Sharon M. Hinton (County), and Nancy Coston (County) were also included in 1 or more
meetings. Meetings included an agenda sent to all participants, and follow-up minutes were
circulated.
Below, in red, are my responses to the questions raised by three (3) of the County
Commisioners.
Questions from Commissioner Marilyn Carter:
General question re: division of ownership %:
Wayne Hadler: I have drafted deeds that will result in Orange County owning a 53.6% undivided
interest in the real property and the Town of Carrboro owning a 46.4% interest. Both parties
will convey the two (2) Condominium Units as follows: Orange County will be the Unit 1 Owner,
with a 53.6% share of the interest of the Common Elements of the Condominium; and the Town
of Carrboro will be the Unit 2 Owner with a 46.4% interest in the Common Elements.
How is the parking garage factored into this?
