The Insurer, by such inspections, surveys, reports, or recommendations, does not warrant that the <br /> Insured Entity's Network is safe or in compliance with laws, regulations, codes or standards, domestic or <br /> foreign. This condition applies not only to the Insurer, but also to any rating, advisory, rate service, or similar <br /> organization which makes insurance inspections, surveys, reports or recommendations. <br /> Such inspections or surveys will be arranged with mutual consent of the Insured Entity and Insurer. <br /> 4. First Party Loss and Arbitration <br /> If the Insured and the Insurer disagree on the amount of First Party Loss sustained, either may make a <br /> written demand for an appraisal of such First Party Loss. If such demand is made, each party will select an <br /> appraiser. The appraisers will state separately the amount of First Party Loss sustained. If they fail to agree, <br /> the Insured and the Insurer will submit their differences to an impartial third appraiser jointly selected by both <br /> the Insured Entity and the Insurer. A decision agreed to by any two will be binding. The Insured Entity and <br /> the Insurer will each bear their own costs with respect to the selection and retention of their appraisals and <br /> any disputes arising out of the payment of First Party Loss. The Insurer and the Insured Entity shall jointly <br /> bear the costs of the third appraiser. <br /> Any appraisal of First Party Loss shall still be subject to all other terms, conditions and exclusions of this <br /> policy. <br /> V. HEADINGS <br /> The descriptions in the headings of this Policy are solely for convenience, and form no part of the terms and <br /> conditions of coverage. <br /> IN WITNESS WHEREOF, the Insurer has caused this Policy to be signed by its Chairman and Secretary at Chicago, <br /> Illinois, but the same shall not be binding upon the Insurer unless countersigned by a duly authorized representative of the <br /> Insurer. <br /> Chairman Secretary <br /> GSL2302XX (Ed 6/11) <br /> Page 27 <br /> Copyright©2011 CNA.
