Revised 01/24 <br />5.Non-Appropriation A new section 13.19 reads: Notwithstanding any other provision of this Contract, if <br />funding for the continued fulfillment of an Order Form by Customer are at any time not forthcoming <br />or are insufficient due to the failure of any entity to appropriate funds, then Customer will have the <br />right to terminate future additional years of this Contract at no additional cost and with no penalty <br />by giving prior written notice documenting the lack of funding. Customer will provide at least thirty <br />(30) days advance written notice of such termination. The Customer will use reasonable efforts to <br />ensure appropriated funds are available.
