66 <br /> STAFF CONCLUSIONS <br /> Staff has reviewed the application, the site plan, and all supporting documentation and has found that the <br /> applicant complies with the application requirements, notice requirements, specific standards of <br /> evaluation for Recreational Facilities, and required regulations as outlined within the UDO. <br /> Staff has not received any evidence indicating the project does not comply with the UDO, including the <br /> provisions of Section 5.3.2(A)(2), establishing the grounds for making a negative finding on the general <br /> standards as detailed herein. These standards include maintaining or promoting the public health, <br /> safety, and general welfare; maintaining or enhancing the value of contiguous property; determining if <br /> the use is in harmony with the area in which it is to be located; and determining if the use is in <br /> compliance with the general plan for the physical development of the County. <br /> The Board could make an affirmative finding on this application provided the Board of Adjustment finds <br /> satisfaction with the specific standards of evaluation and general standards as detailed herein, and no <br /> evidence is entered into the record demonstrating the applicant has either: <br /> a. Failed to meet their burden of proof that the project complies with the specific development <br /> standards for a telecommunication facility, or <br /> b. Failed to comply with the general standards detailed within Section 5.3.2 (A) (2) of the UDO. <br /> In the event that the Board makes an affirmative finding, and issues the permit, staff recommends the <br /> attachment of the following revised conditions: <br /> SPECIAL TERMS AND CONDITIONS <br /> The conditions of approval are as follows: <br /> 1. Consistent with the submitted Special Use Permit application, and for public safety purposes as <br /> required in UDO Section 5.3.2(B)(2), proposed outdoor athletic fields shall only be used to <br /> support the playing of cricket matches and practices. No other recreational activities are <br /> proposed for the property; <br /> 2. For public safety purposes as required in UDO Section 5.3.2 (13)(2), a street address sign be <br /> assigned by Orange County Land Records, consistent with the County Addressing Ordinance, <br /> prior to the commencement of recreational activities; <br /> 3. Consistent with the submitted Special Use Permit application, applicant testimony, and for <br /> public safety purposes as required in UDO Section 5.3.2 (13)(2), cricket play shall only: <br /> a. Occur from the months of April through November, <br /> b. Be played during weekends and long weekends (Saturday and/or Sunday) with <br /> practices being limited to four days a week for no more than 4 hours during <br /> daylight hours, and <br /> C. Permission to conduct wash-out games (make-up games) during weekdays but <br /> limited to some weekdays (not every week). <br /> 4. Consistent with the submitted Special Use Permit application, and for public safety purposes as <br /> required in UDO Section 5.3.2 (B) (2), matches are for social/recreational purposes only. Use <br /> of the recreation facility will not be part of a professional league associated with earning prize <br /> money or other form of monetary gain for participants; <br /> 5. There shall be no use of Holly Creek Lane to support activities on the property (i.e. field access, <br /> parking, or staging of vehicles with the exception of public safety vehicles responding to an <br /> emergency); <br />
