32 <br /> SUP25-0002 <br /> https://centralpermits.orangecountync.gov/EnerGov Prod/SelfService#/plan/3980al85-cb27- <br /> 48df-898c-b053a6a1 e354?tab=attachments <br /> Basic Review Process: An application for major modification to an approved Special Use Permit <br /> requires submission of an amended site plan and written narrative outlining the specific changes <br /> requested, in accordance with Section 2.7.14(E) of the UDO: <br /> • FIRST ACTION — Staff Review/Analysis Begins <br /> STAFF COMMENT: An analysis of the application was made by qualified <br /> representatives of the County and other agencies or officials. <br /> • SECOND ACTION — Development Advisory Committee Review/Analysis <br /> STAFF COMMENT: The Orange County Development Advisory Committee <br /> (DAC) met May 1, 2025, to review this request. DAC comments are available <br /> on-line via the Customer Service Portal link above. <br /> • THIRD ACTION — The BOA sets an Evidentiary Hearing to receive testimony <br /> concerning the modification request. <br /> STAFF COMMENT: The hearing is anticipated to be held on June 11, 2025. <br /> A formal application is required as part of this SUP modification request and has been submitted <br /> (Attachment 2). Approval of the application is part of the Special Use Permit process and shall <br /> include making appropriate findings of fact stating that the Board concludes all applicable <br /> standards have been met. <br /> Public Notification(s): In accordance with UDO Sections 2.7.6 and 2.7.14(E), notices of the <br /> Evidentiary Hearing were mailed via first class mail to all adjacent property owners of the <br /> subject parcel. These notices were mailed on May 28, 2025, 14 days before the meeting. Staff <br /> also posted the property with signs on May 28, 2025, 14 days before the meeting. See <br /> Attachment 3 for the notification materials. <br /> Planning Director's Comments: The Planning Director has determined the application is <br /> complete. The submitted site plan revision is consistent with the established site plan <br /> requirements of UDO Section 2.5 and the established development standards detailed in <br /> Section 5.7.2. Neither the Director nor the Planning Staff make a formal recommendation on <br /> Board action regarding an application, nor on the compliance of the project with the "Special <br /> Uses" General Standards in Section 5.3.2(A)(2). <br /> Board of Adjustment Findings and Actions <br /> The Board of Adjustment must determine, based upon submitted evidence and testimony, if: <br /> (a) The use will maintain or promote the public health, safety and general welfare, if <br /> located where proposed and developed and operated according to the plan as <br /> submitted; <br />
