<br />3 <br />(i) TABLE shall be permitted to use land, agricultural infrastructure, equipment, <br />utilities and other resources upon terms and conditions, including rates, directly negotiated <br />between TABLE and the COUNTY and outlined in Exhibit B and C. Any costs of services <br />to be added to the Property, such as water and sewer and electrical connections and bills, <br />shall be the responsibility of TABLE. <br /> <br />(j) Upon reasonable notice, TABLE shall provide the COUNTY access to its <br />farming and insurance records necessary to prove TABLE’s compliance with the terms of <br />this Agreement. Should such inspection raise concerns that TABLE is in violation of <br />applicable laws, rules, policies or safety practices, then TABLE’s use of the Property can <br />be suspended immediately by the COUNTY until resolution of potential violation(s) is <br />accomplished to the COUNTY’s satisfaction. TABLE’s sole recourse in the event of such <br />suspension shall be the refund of applicable usage fees for any periods of suspension lasting <br />more than seven (7) days. <br /> <br />(k) TABLE will use the Property only for the Purpose set forth in Exhibit B as it <br />may be amended by the Parties from time to time. <br /> <br />(l) The following uses of the Property are expressly prohibited: <br /> <br />i. Growing or processing tobacco; <br />ii. Dumping of trash or debris on the Farm; <br />iii. Residing or dwelling on the Farm overnight, unless for reasons directly <br />connected to the Purpose and pre-approved by the COUNTY; <br />iv. Burning, starting fires, shooting firearms or fireworks without express <br />permission from the COUNTY; <br />v. Removing soil, equipment, infrastructure, buildings, timber or other <br />materials from the Farm which is owned by the COUNTY or other <br />licensees; <br />vi. Hunting; <br />vii. Trapping for purposes other than maintaining sanitation or controlling <br />depredation by varmints; <br />viii. Intentional application of substances to the land that do not meet <br />sustainable agriculture standards. <br /> <br />5. COUNTY Obligations/Disclaimers. <br /> <br />(a) The COUNTY will maintain ownership of the Property. <br />(b) The COUNTY shall have no liability for or obligation to Personnel. <br />6. Security Deposit. Upon the execution of this Agreement, TABLE shall deposit with the <br />COUNTY twenty-five (25) percent of the annual farm plot usage fee which amount will <br />serve as security for the full and faithful performance by TABLE of all the terms, covenants <br />and conditions of this Agreement to be performed by TABLE, against which sum the <br />COUNTY is authorized to charge any damages it may sustain as the result of the failure of <br />TABLE to fully and faithfully perform all of said terms, covenants and conditions.
