Article 10: Definitions 46 <br /> Section 10.1: Definitions <br /> Telecommunication Facilities, Communications Service <br /> Cable service as defined in 47 U.S.C. § 522(6), information service as defined in 47 U.S.C. § 153(24), <br /> telecommunications service as defined in 47 U.S.C. § 153(53), or wireless services.'- <br /> 1) 47 USC § 522 "(6): the term "cable service" means– <br /> (A)the one-way transmission to subscribers of(i) video programming, or (ii) other <br /> programming service, and <br /> (B) subscriber interaction, if any, which is required for the selection or use of such video <br /> programming or other programming service;" <br /> 2) 47 USC 153(24) See definition of Telecommunications Facilities, Communications Service <br /> Provider. <br /> 4-)-47 USC § 153 (53) "The term "telecommunications service" means the offering of <br /> telecommunications for a fee directly to the public, or to such classes of users as to be <br /> effectively available directly to the public, regardless of the facilities used." <br /> Telecommunication Facilities, Communications Service Provider <br /> A cable operator as defined in 47 U.S.C. § 522(5); a provider of information service, as defined in 47 <br /> U.S.C. 153(24); telecommunications carrier, as defined in 47 U.S.C. § 153(51); or a wireless provider.$ <br /> 1) 47 U.S.C. 522(5) "the term "cable operator" means any person or group of persons (A)who <br /> provides cable service over a cable system and directly or through one or more affiliates owns a <br /> significant interest in such cable system, or (B)who otherwise controls or is responsible for, <br /> through any arrangement, the management and operation of such a cable system. <br /> 2) 47 U.S.C. 153 (24) "The term "information service" means the offering of a capability for <br /> generating, acquiring, storing, transforming, processing, retrieving, utilizing, or making available <br /> information via telecommunications, and includes electronic publishing, but does not include any <br /> use of any such capability for the management, control, or operation of a telecommunications <br /> system or the management of a telecommunications service. <br /> 3) 47 U.S.C. 153 (51) "The term "telecommunications carrier" means any provider of <br /> telecommunications services, except that such term does not include aggregators of <br /> telecommunications services (as defined in section 226 [47 USCS § 2261).
