Article 5: Uses 42 <br /> Section 5.10: Standards for Telecommunication Facilities <br /> 5.10.7 Abandonment <br /> (A) The wireless telecommunications facility shall be deemed abandoned if wireless <br /> telecommunications signals do not resume for a period of 180 consecutive days or longer <br /> from the date the written documentation of cessation is filed. <br /> (B) Upon making a determination that a wireless telecommunications facility has been <br /> abandoned, the County shall forward written documentation of the abandonment to the <br /> wireless services provider, and the owner of the land, if different. <br /> (C) The deadline to remove the wireless support structure shall be 180 days for small /micro <br /> wireless facilities. <br /> 5.10.8 Removal <br /> (A) The County may require the wireless services provider or the owner of the land, if <br /> different, to remove an abandoned wireless telecommunications facility within 30 days of <br /> the date it is deemed abandoned, according to Section 5.10.9. <br /> (B) Should the wireless services provider, or the owner of the land, if different, fail to remove <br /> the abandoned telecommunications facility within 30 days of the date that notice of <br /> abandonment is filed, the County may remove the wireless telecommunications facility <br /> and recover the actual cost of such removal, including legal fees, from the wireless <br /> services provider and the owner of the land, if different. The county reserves the right to <br /> place a lien upon the property for unrecovered costs associated with the removal of the <br /> wireless communication facility. <br /> (C) The deadline shall be 180 days for small /micro wireless facilities. <br /> 5.10.9 Temporary Use Permits for Wireless Support Structures and Facilities <br /> (A) Notwithstanding anything in this Section to the contrary, the County may approve a <br /> temporary use permit/agreement for a facility for no more than 90 days, during which time <br /> the applicant shall develop a plan for facility removal, conversion to another type of <br /> wireless support structure, or relocation. All such modifications to the existing wireless <br /> communications facility shall be subject to the approval of the County. <br /> (1) EXCEPTION. Upon the declaration of a state of emergency by U.S. or N.C. <br /> State government(s), temporary, commercial wireless communications facilities <br /> may be granted temporary use permits for multiple 90-day terms. No emergency <br /> temporary use permit shall be granted more than 90 days after a state of <br /> emergency, or determination of public necessity ends. <br /> (B) If such a plan is not developed, approved and executed within the 90-day time period, <br /> then the County may take possession of and dispose of the affected facility in the manner <br /> provided in this Section and utilize the filed bond or other security. <br /> 5.10.10 Ham Radio Antennas <br /> (A) Standards of Evaluation <br /> (1) Shall be for the non-commercial use of the property owner on which they are <br /> located. <br /> (2) Shall not exceed 90 ft. in height. <br /> (3) Setbacks from the base of the antenna to the property boundary shall be equal to <br /> 110% of the tower height. <br /> 5.10.11 Non-Conforminq Wireless Telecommunications Facilities <br /> See section 8.14. <br /> Orange County, North Carolina—Unified Development Ordinance Page 5-100 <br />
