Article 5: Uses 41 <br /> Section 5.10: Standards for Telecommunication Facilities <br /> (E) Maximum height <br /> No new structure intended to support a small wireless facility shall be taller than 50 feet <br /> above the adjacent, pre-construction grade. An existing structure (such as a utility pole, <br /> light standard, sign, etc.) may be replaced in order to accommodate a small wireless <br /> facility, but the replacement structure shall not exceed the height of the original structure <br /> being replaced or 50 feet, whichever is taller. In cases where a new structure is installed <br /> to serve a small wireless facility exceeds 50 feet in height, the structure shall be reviewed <br /> and decided in accordance with the standards for a wireless communications facility, as <br /> defined and regulated bV Section 5.10. <br /> (1) The antennae or equipment associated with a small wireless facility project shall <br /> not exceed ten feet above the height of the structure the small wireless facility is <br /> mounted on. In cases where a replacement structure intended to serve a small <br /> wireless exceeds the height of the original structure, the replacement structure <br /> shall be reviewed and decided in accordance with the standards for a collocation. <br /> (F) Placement <br /> A small wireless facility, including the support structure and all other equipment, shall not <br /> obstruct the safe passage of vehicles, pedestrians, or bicycles. <br /> (G) Method of attachment <br /> All equipment associated with a small wireless facility shall be fastened to a supporting <br /> structure in a manner that minimizes the potential for structural failure, as justified and <br /> established in a signed and sealed analysis from a professional engineer. <br /> (H) Appearance <br /> The portion of a small/micro wireless facility attached to the support structure shall match <br /> the color of the support structure, to the maximum extent practicable. In cases where an <br /> applicant proposes inclusion of a small / micro wireless facility on a decorative support <br /> structure, sign, or other existing structure not constructed solely for the purposes of <br /> providing wireless telecommunications services, the County may require the small <br /> wireless facility to be configured or concealed to ensure compatibility with the structure as <br /> a condition of approval. <br /> (1) Electrical service <br /> In cases where a small/micro wireless facility is proposed in areas where electrical <br /> service is underground, all electrical service to power the small wireless facility shall also <br /> be underground. <br /> 5.10.6 Cessation <br /> (A) A wireless telecommunication facility shall be considered to have ceased operation if the <br /> County receives written notice from a wireless services provider that it intends to cease <br /> operations at a particular wireless telecommunication facility, or a wireless <br /> telecommunications facility ceases to transmit a wireless telecommunications signal for a <br /> period of 30 consecutive days or longer. <br /> (B) Upon receipt of a written notice from a wireless services provider or upon determination <br /> that a wireless communication facility has ceased operation, the County shall forward <br /> written documentation of the cessation to the wireless services provider, and the owner of <br /> the land, if different. <br /> (C) The deadline to remove the wireless support structure shall be 180 days for small /micro <br /> wireless facilities. <br /> Orange County, North Carolina—Unified Development Ordinance Page 5-99 <br />
